Meeting No. 28

Wednesday, May 6, 1998

The Standing Committee on Aboriginal Affairs and Northern Development met at 3:43 o’clock p.m., this day, in room 705, La Promenade, the Chair, Guy Saint-Julien, presiding.

Members of the Committee present: Gordon Earle, John Finlay, Ghislain Fournier, David Iftody, Nancy Karetak-Lindell, Gerald Keddy, Bernard Patry, Guy Saint-Julien, Mike Scott and Bryon Wilfert.

Acting Members present: Reg Alcock for Judi Longfield; Lou Sekora for Lawrence O’Brien.

In attendance: From Committees and Legislative Services: Paulette Nadeau and Suzanne Verville, Legislative Clerks. From the Parliamentary Research Branch of the Library of Parliament: Mary C. Hurley and Jill Wherrett, Research Officers.

Witnesses: From the Department of Indian and Nothern Affairs: Gilles Binda, Senior Policy Advisor, Nunavut Secretariat, Northern Program; John Merritt, Senior Advisor, Nunavut Secretariat, Northern Program; Mary Douglas, Legal Counsel.

The Committee resumed consideration of Bill C-39, An Act to amend the Nunavut Act and the Constitution Act, 1867. (See Minutes of Proceedings and Evidence of Wednesday, April 29, 1998, Meeting No. 25)

The Committee commenced Clause by Clause consideration of the Bill.

The witnesses answered questions.

Clauses 1 –12 carried severally.

On Clause 13

Gerald Keddy moved, --That Bill C-39, in Clause 13, be amended by adding after line 20 on page 6 the following:

"(2.1) Section 73 of the Act is amended by adding the following after subsection (1):

(1.1) The Commissioner shall cause to be laid before the Legislative Assembly of Nunavut any agreement entered into under subsection (1)."

Ghislain Fournier moved, --That the amendment be amended in the French version by replacing "fait déposer" with "doit faire déposer".

And the question being put on the sub-amendment, it was agreed to.

And the question being put on the amendment, as amended, it was agreed to.

Clause 13 as amended, carried.

Clause 14 carried.

Claude 15 carried.

On Clause 16

Gerald Keddy moved, --That Bill C-39, in Clause 16, be amended

(a) by replacing line 6 on page 10 with the following:

"in Council shall, before the day that section 3"

(b) by replacing line 12 on page 10 with the following:

"governing the elections and shall be before or"

After debate, the question being put on the amendment, it was negatived.

Clause 16 carried.

Clauses 17 to 42 carried.

On Clause 43

After debate, Clause 43 carried on division.

Clauses 44-51 carried severally on division.

On Clause 52

After debate, Clause 52 carried on division.

The Title carried.

The Bill as amended, carried on division.

It was agreed on division, -That the Chair report the Bill to the House on Thursday, May 7, 1998.

At 4:29 o’clock p.m., the Committee adjourned to the call of the Chair.
