The Standing Committee on Aboriginal Affairs, Northern Development and Natural Resources met at 3:35 p.m. this day, in Room 209, West Block, the Chair, Raymond Bonin, presiding.

Members of the Committee present: Larry Bagnell, Gérard Binet, Raymond Bonin, Serge Cardin, David Chatters, John Finlay, John Godfrey, Nancy Karetak-Lindell, Gerald Keddy, Benoît Serré, Maurice Vellacott.

Acting Members present: Yvon Charbonneau for Jean-Guy Carignan;  Allan Tonks for Guy St-Julien;  Jocelyne Girard-Bujold for Richard Marceau;  Joe Comartin for Pat Martin.

Pursuant to its Order of Reference of Tuesday, October 2, 2001, the Committee resumed consideration of Bill C-27, An Act respecting the long-term management of nuclear fuel waste (See Minutes of Proceedings, Thursday, November 1st, 2001, Meeting No. 27).

The Committee resumed Clause-by-Clause consideration of the Bill.

By unanimous consent, the Committee reverted to Clause 12.

Gerald Keddy moved, --

That Bill C-27, in Clause 12, be amended by replacing line 10 on page 6 with the following:

"organization shall table in both Houses of Parliament a"

After debate, the question being put on the amendment, it was, by a show of hands, negatived: YEAS: 2;  NAYS: 7.

Serge Cardin moved, - That Bill C-27, in Clause 12, be amended by replacing line 10 on page 6 with the following:

David Chatters moved, - That Bill C-27, in Clause 16, be amended by replacing line 40 on page 8 with the following:

“year, which the Minister shall table in both Houses of Parliament within 60 days after receiving it.”

On new Clause 18(1)

Joe Comartin moved, --

That Bill C-27 be amended by adding after line 13 on page 11 the following new clause:

"18.1 Before implementing any plan to dispose of nuclear fuel waste in the Canadian Shield, the waste management organization shall

(a) undertake a review of all pertinent social and technical shortcomings identified by the Scientific Review Group, as well as the other review participants, as set out in the Report of the Nuclear Fuel Waste Management and Disposal Concept Environmental Assessment Panel dated February 1998; and

(b) establish an order of priority in which these shortcomings must be dealt with, generate a plan to address them; consult the public on the plan; and then carry out whatever additional work is necessary in terms of the investigation and resolution of the shortcomings prior to finalizing its recommendation to the government."

After debate, the question being put on the amendment, it was, by a show of hands, negatived: YEAS: 5;  NAYS: 7.

On Clause 19,

Gerald Keddy moved, -- That Bill C-27, in Clause 19, be amended by replacing lines 14 to 16 on page 11 with the following:

“19. The Minister shall, within 90 days after receiving a report, issue a public statement regarding the report.”

After debate, the question being put on the amendment, it was unanimously agreed to.

Clause 19, as amended, carried.

On new Clause ( 19.1 )

Benoît Serré moved, -- That Bill C-27 be amended by adding after line 16 on page 11 the following:

“19.1 The Minister shall cause a copy of each report to be laid before each House of Parliament within the first fifteen sitting days of that House after the Minister has received the report.”

After debate, the question being put on the amendment, it was, by a show of hands, agreed to: YEAS: 10;  NAYS: 2.

New Clause 19.1 carried.

On Clause 20,

Serge Cardin moved, -- That Bill C-27, in Clause 20, be amended by replacing line 22 on page 11 with the following:

"tion shall so report to the members of the House of Commons in its triennial report and"

After debate, the question being put on the amendment, it was, by a show of hands, negatived: YEAS: 5;  NAYS: 7.

Clause 20 carried on division.

On Clause 21,

Gerald Keddy moved, -- That Bill C-27, in Clause 21, be amended by adding after line 21 on page 12 the following:

"(2) For the purposes of subsection (1), "beneficiary" means any nuclear energy corporation, including Atomic Energy of Canada Limited, that has deposited funds to a trust fund."

After debate, by unanimous consent, it was agreed, - That the amendment be withdrawn.

Joe Comartin moved, --

That Bill C-27 be amended by adding after line 21 on page 12 the following new clause:

"21.1 The Governor in Council shall conduct a public review of any withdrawals from the trust funds when the fund balance exceeds the cost estimate for the selected approach."

After debate, the question being put on the amendment, it was, by a show of hands, negatived: YEAS: 5;  NAYS: 7.

On Clause 22,

That Bill C-27, in Clause 22, be amended by replacing lines 23 and 24 on page 12 with the following:

On Clause 25

Serge Cardin moved, --That Bill C-27, in Clause 25, be amended by replacing lines 17 to 19 on page 13 with the following:

"25. (1) For the purposes of this section and section 26, "auditor" means the Auditor General of Canada."

After debate, the question being put on the amendment, it was, by a show of hands, negatived: YEAS: 4;  NAYS: 7.

Serge Cardin moved, - That Bill C-27, in Clause 25, be amended by replacing lines 17 to 19 on page 13 with the following:

“25. (1) The Minister shall designate the Auditor General of Canada as the auditor for the purposes of this Act.”

On Clause 31,

Serge Cardin moved, - That Bill C-27 be amended by adding after line 32 on page 15 the following new clause:

"31.1 No person shall import nuclear fuel waste into Canada."

On Clause 1,

Gerald Keddy moved, - That Bill C-27, in Clause 1, be amended by replacing lines 4 and 5 on page 1 with the following:

“1. This Act may be cited as the Irradiated Nuclear Fuel Act.”

After debate, the question being put on the amendment, it was, by a show of hands, negatived: YEAS: 3;  NAYS: 10.

It was agreed, - That the Committee proceed to Clause by Clause consideration of Bill C-37 on Tuesday, November 27, 2001 from 12:00 p.m. to 2:00 p.m.

It was agreed, - That the Minister of Natural Resources be invited to appear regarding the Supplementary Estimates (A) for the fiscal year ending March 31, 2002.

It was agreed, - That the Minister of Aboriginal Affairs and Northern Development be invited to appear regarding the Supplementary Estimates (A) for the fiscal year ending March 31, 2002.
