The Standing Committee on Agriculture and Agri-food met at 3:41 p.m., this day, in Room

208, West Block, Joe McGuire, presiding.

Members of the Committee present: Rick Borotsik, Denis Coderre, John Harvard, Jay Hill, Jake E. Hoeppner, Larry McCormick, Joe McGuire, Dick Proctor and Rose-Marie Ur.

Acting Members of the Committee present: Ovid Jackson for Paul Bonwick; Charles Hubbard for Gerry Byrne; Gurbax Malhi for Murray Calder; Hec Clouthier for Paul Steckle and René Canuel for Hélène Alarie.

In attendance: From the Parliamentary Research Branch: Sonya Dakers, Research Coordinator, Jean-Denis Fréchette, Researcher and Frédéric Forge, Researcher. From the Committees and Legislative Services: Marc Toupin and Paulette Nadeau, Legislative Clerks.

The Committee resumed consideration of Bill C-26, An Act to Amend the Canada Grain Act and the Agriculture and Agri-Food Administration Monetary Penalties Act and to Repeal the Grain Futures Act (See Minutes of Proceedings of Thursday, April 2, 1998, Meeting No. 31).

On motion of John Harvard, seconded by Dick Proctor, it was agreed, -- That, the Committee approve a budget for the period of April 1st, 1998 to June 30, 1998, in the amount of $62,443.50 to cover witnesses expenses on the study of Bill C-26, the Canada Grain Act, and on the Biotech Study.

 

The Chairman called Clause 1.

John Harvard moved, -- That Bill C-26, in Clause 1, be amended by replacing line 28 on page 2 with the following:

"Act or the regulations or any order that may be proceed-"

After debate, the question being put on the motion, it was agreed to.

Clause 1, as amended, carried.

 

Clause 2, carried.

Clause 3, carried.

Clause 4, carried.

 

On Clause 5

Jay Hill moved, -- That Bill C-26, in Clause 5, be amended, in the English version only,

(a) by replacing lines 2 to 5 on page 4 with the following:

"receive special crops, the insurance plan described in section 49.01 is in effect and the applicant has not been approved by the insurer of that plan; or"

(b) by replacing lines 27 to 29 on page 4 with the following:

"crops, the insurance plan described in section 49.01 is in effect and the applicant has not been approved by the insurer of that plan."

(c) by replacing lines 31 to 33 on page 4 with the following:

"a special crops dealer's licence if the insurance plan described in 49.01 is in effect and the applicant has not been approved by the insurer of that plan."

After debate, the question being put on the motion, it was agreed to.

 

Clause 5, as amended, carried.

 

Clause 6, carried.

 

On Clause 7

Jay Hill moved, -- That Bill C-26, in Clause 7, be amended by adding after line 10 on page 6 the following:

" (2.1) Subject to subsection (2.2), a producer of special crops may participate in an insurance plan established under subsection (2) but shall not be required to do so.

(2.2) A producer may participate in an insurance plan referred to in subsection (2.1) only where the producer has notified the agent, in writing, within the prescribed time, of the producer's intention to do so."

After debate, the question being put on the motion, it was negatived on the following division:

By unanimous consent, it was agreed, -- That the vote just taken be applied to the following four other consequential motions, which were also negatived.

 

On Clause 7

Jay Hill was deemed to have moved, -- That Bill C-26, in Clause 7, be amended by replacing lines 10 and 11 on page 7 with the following:

" (8) A producer of special crops may withdraw from the insur-"

and On Clause 24

Jay Hill was deemed to have moved, -- That Bill C-26, in Clause 24, be amended

(a) by replacing line 14 on page 15 with the following:

"information, and"

(b) by deleting lines 15 to 18 on page 15.

Jay Hill was deemed to have moved, -- That Bill C-26, in Clause 24, be amended by replacing lines 15 to 18 on page 15 with the following:

" (vi) subject to subsection 49.01(2.2), specifying the terms and conditions for participation in, and prescribing the manner in which a producer may withdraw from the insurance plan, and "

Jay Hill was deemed to have moved, -- That Bill C-26, in Clause 24, be amended

(a) by replacing line 18 on page 15 with the following:

" cial crops,"

(b) by replacing line 21 on page 15 with the following:

"insurance plan, and

(viii) prescribing the time within which a producer of special crops shall notify the agent of the producer's intention to participate in the insurance plan."

On Clause 7

Jay Hill moved, -- That Bill C-26, in Clause 7, be amended by replacing lines 11 to 14 on page 6 with the following:

" (3) A producer of special crops who delivers or causes to be delivered such a crop to a licensee when an insurance plan described in subsection (2) is in effect shall pay to the licensee in the prescribed manner the prescribed levy."

After debate, the question being put on the motion, it was agreed to.

Rose-Marie Ur moved, -- That Bill C-26, in Clause 7, be amended by replacing line 12 on page 7 with the following:

"ance plan described in this session. The agent must reimburse the producer for the amount of any levy the producer paid under subsection (3) for the period after the producer's withdrawal from the plan."

After debate, the question being put on the motion , it was agreed to.

Denis Coderre moved, --That Bill C-26, in Clause 7, be amended by replacing, in the French version, lines 24 and 25 on page 7 with the following:

"producteurs de cultures spéciales qui ne sont pas négociants en ces cultures ou en"

The question being put on the amendment, it was agreed to.

Clause 7, as amended, carried.

 

Clauses 8 to 23 inclusive carried.

 

On Clause 24

John Harvard moved, -- That Bill C-26, in clause 24, be amended by replacing line 35 on page 14 with the following:

"(a.1) designating any grain, except wheat, oats, barley, rye, canola and flax, as a special crop"

After debate, the question being put on the amendment, it was agreed to.

 

Clause 24, as amended, carried.

 

Clauses 25 to 30 inclusive carried.

 

The Title carried.

The Bill, as amended, carried.

 

It was agreed, -- That the Chairman report Bill C-26, as amended, to the House.

 

It was agreed, -- That the Committee order a reprint of Bill C-26, Act to Amend the Canada Grain Act and the Agriculture and Agri-Food Administration Monetary Penalties Act and to Repeal the Grain Futures Act for use at Report Stage.

During the course of the meeting, the Parliamentary Secretary to the Minister of Agriculture and Agri-Food and the witnesses answered questions.
