Pursuant to Standing Order 108(2) and the motion adopted by the Committee on Tuesday, February 6, 2018, the Committee resumed its study of the Immigration and Refugee Board's appointment, training and complaint processes.

barbara findlay, Q.C., by videoconference from Vancouver, British Columbia, and Cheryl Robinson made statements and answered questions.

On motion of Jenny Kwan, it was agreed, — That, in relation to its study of Immigration and Refugee Board's appointment, training and complaint processes, the Committee send for the interim third-party report prepared by Neil Yeates from the Immigration and Refugee Board (IRB); that this document be provided to the Committee by Tuesday, May 1, 2018, and that if the IRB is unable to deliver the report, that the IRB provide an explanation as to why.

Jenny Kwan raised a point order regarding answers to questions received by the Department of Citizenship and Immigration.

RULING BY THE CHAIR

The Chair ruled that it is not his role to judge the answers given to the Committee.

Whereupon, Jenny Kwan appealed the decision of the Chair.

The question: "Shall the decision of the Chair be sustained?" was put and the decision was sustained, by a show of hands: YEAS: 7; NAYS: 1.

Motion

Jenny Kwan moved, — That officials from the Department of Citizenship and Immigration be requested to come back to the Committee and to provide an explanation to the Committee with respect to requests on the undertakings.

Gary Anandasangaree moved, — That the debate be now adjourned.

The question was put on the motion and it was agreed to, by a show of hands: YEAS: 7; NAYS: 1.

Gary Anandasangaree moved, — That the Committee move to the next item of business on the agenda.

By unanimous consent, the motion was withdrawn.

Questioning of barbara findlay, Q.C. resumed.

At 1:02 p.m., the Committee adjourned to the call of the Chair.
