The Subcommittee on Public Safety and National Security of the Standing Committee on Justice, Human Rights, Public Safety and Emergency Preparedness met at 3:30 p.m. this day, in Room 362 East Block, the Chair, Paul Zed, presiding.

 

Members of the Subcommittee present: Joe Comartin, Roy Cullen, Peter MacKay, Serge Ménard, Kevin Sorenson, Tom Wappel and Paul Zed.

 

In attendance: Library of Parliament: Philip Rosen, Analyst; Robin MacKay, Analyst.

 

Witnesses: Department of Public Safety and Emergency Preparedness: David Dunbar, Acting General Counsel; Denis Lefebvre, Executive Vice-President, Canada Border Services Agency; Candace Breakwell, Director, Legislative Affairs & ATIP.

 
Pursuant to the Order of Reference of Monday, December 13, 2004, the Subcommittee resumed consideration of Bill C-26, An Act to establish the Canada Border Services Agency.
 

Pursuant to Standing Order 75(1), consideration of Clause 1 was postponed.

The Chair called Clause 2.

 

Clauses 2 to 15 inclusive carried severally.

 
Peter MacKay moved, — That Bill C-26 be amended by adding after line 4 on page 7 the following new clause:

“15.1 (1) The Minister shall, as soon as possible after the end of each fiscal year but no later than the end of the calendar year in which that fiscal year ends, cause to be laid before each House of Parliament a report of the operations and performance of the Agency for that fiscal year.

(2) The obligation imposed by subsection (1) may be satisfied by the tabling of any reports of the operations and performance of the Agency required by the Treasury Board that contain the information required by that subsection. ”

Debate arose thereon.

 

After debate, by unanimous consent, the amendment was allowed to stand.

 

By unanimous consent, Clauses 16 to 32 inclusive carried.

 

By unanimous consent, Clauses 33 to 57 inclusive carried.

 

On Clause 58,

Roy Cullen moved, — That Bill C-26, in Clause 58, be amended by adding after line 5 on page 22 the following:

“(d.1) an officer authorized under subsection 138(1) of the Immigration and Refugee Protection Act,”

 

After debate, the question was put on the amendment of Roy Cullen and it was agreed to.

 

Clause 58, as amended, carried.

 

By unanimous consent, Clauses 59 to 76 inclusive carried.

 

By unanimous consent, Clauses 77 to 98 inclusive carried.

 

By unanimous consent, Clauses 99 to 120 inclusive carried.

 

By unanimous consent, Clauses 121 to 143 inclusive carried.

 

Clauses 144 to 147 inclusive carried severally.

 
The Committee resumed consideration of the amendment of Peter MacKay, — That Bill C-26 be amended by adding after line 4 on page 7 the following new clause:

It was agreed, — That the Chair report the Bill, as amended, to the Standing Committee on Justice, Human Rights, Public Safety and Emergency Preparedness.

 
The Subcommittee proceeded to the consideration of matters related to Subcommittee business.
 

It was agreed, — That the work plan circulated to members concerning the Subcommittee’s schedule for February and March be adopted.

Notice was given by Mr. Comartin of a motion concerning the inclusion of s. 4 of the Security of Information Act and the use of security certificates as part of the review of the Anti-terrorism Act.

It was agreed, — That the motion of Mr. Comartin be taken up at the next meeting of the Subcommittee.

It was agreed, — That the clerk verify whether the Standing Committee on Citizenship and Immigration intends to review the use of security certificates.

It was agreed, — That the clerk and the researchers prepare a draft work plan concerning the next stages of the review of the Anti-terrorism Act and that it be circulated to members for their consideration.

 

At 5:30 p.m., the Subcommittee adjourned to the call of the Chair.
