The Standing Committee on Justice and Human Rights met at 3:31 p.m. this day, in Room 306, La Promenade Building, the Chair, Dave MacKenzie, presiding.

 

Members of the Committee present: Françoise Boivin, Raymond Côté, Hon. Irwin Cotler, Kerry-Lynne D. Findlay, Robert Goguen, Pierre Jacob, Brian Jean, Dave MacKenzie and Kyle Seeback.

 

Acting Members present: Lysane Blanchette-Lamothe for Craig Scott, Ryan Leef for Dan Albas and LaVar Payne for Brent Rathgeber.

 

In attendance: House of Commons: Chloé O'Shaughnessy, Legislative Clerk. Library of Parliament: Dominique Valiquet, Analyst.

 

Witnesses: Department of Justice: Matthias Villetorte, Counsel, Criminal Law Policy Section.

 
Pursuant to the Order of Reference of Wednesday, June 20, 2012, the Committee resumed consideration of Bill C-36, An Act to amend the Criminal Code (elder abuse).
 

The witness answered questions.

 

The Committee commenced its clause-by-clause study of the Bill.

 

Pursuant to Standing Order 75(1), consideration of Clause 1 was postponed.

The Chair called Clause 2.

 

On Clause 2,

Françoise Boivin moved, — That Bill C-36, in Clause 2, be amended by replacing lines 9 and 10 on page 1 with the following:

“(iii.1) evidence that the offence had an impact on the victim, consider-”

 

After debate, the question was put on the amendment of Françoise Boivin and it was negatived, by a show of hands: YEAS: 4; NAYS: 6.

 

Clause 2 carried by a show of hands: YEAS: 10; NAYS: 0.

 

Clause 3 carried by a show of hands: YEAS: 10; NAYS: 0.

 

On Short Title,

Françoise Boivin moved, — That Bill C-36, in the short title, be amended by replacing line 4 on page 1 with the following:

1. Loi sur la protection des personnes aînées

 

After debate, the question was put on the amendment of Françoise Boivin and it was agreed to.

 

The Short Title, as amended, carried.

 

The Title carried.

 

The Bill , as amended, carried.

 

ORDERED, — That the Chair report the Bill , as amended, to the House.

 

ORDERED, — That Bill C-36, as amended, be reprinted for the use of the House at report stage.

 

At 3:59 p.m., the sitting was suspended.

At 4:00 p.m., the sitting resumed.

 
The Committee proceeded to the consideration of matters related to Committee business.
 

It was agreed, — That the Committee study Bill C-37, An Act to amend the Criminal Code, by inviting the Minister of Justice and Attorney General of Canada, Rob Nicholson and Senior Officials on Tuesday, October 23, 2012.

That the Committee hear witnesses on Bill C-37, An Act to amend the Criminal Code, on Thursday, October 25, Tuesday, October 30 and Thursday, November 1st, if necessary;

That the clause by clause consideration of Bill C-37, An Act to amend the Criminal code commence on Thursday, November 1st, 2012.

 

At 4:06 p.m., the Committee adjourned to the call of the Chair.
