Wednesday, February 6, 2013

The Standing Committee on Justice and Human Rights met in a televised session at 3:30 p.m. this day, in Room 253-D, Centre Block, the Chair, Mike Wallace, presiding.

Members of the Committee present: Dan Albas, Scott Armstrong, Françoise Boivin, Kerry-Lynne D. Findlay, Robert Goguen, Pierre Jacob, Hoang Mai, Brent Rathgeber, Kyle Seeback and Mike Wallace.

Acting Members present: Hon. Carolyn Bennett for Hon. Irwin Cotler and Craig Scott for Wayne Marston.

In attendance: Library of Parliament: Cynthia Kirkby, Analyst ; Dominique Valiquet, Analyst.

Appearing: Hon. Rob Nicholson, P.C., M.P., Minister of Justice and Attorney General of Canada.

Witnesses: Department of Justice: Donald K. Piragoff, Senior Assistant Deputy Minister, Policy Sector; Greg Koster, Counsel, Criminal Law Policy Section.

Pursuant to the Order of Reference of Friday, November 30, 2012, the Committee commenced consideration of Bill S-9, An Act to amend the Criminal Code.

The Minister made a statement and answered questions.

Françoise Boivin gave notice of the following motion:

That the Committee conduct a thorough study of the practice under s.4.1(1) of the Department of Justice Act since its enactment, which states:

“4.1 (1) Subject to subsection (2), the Minister shall, in accordance with such regulations as may be prescribed by the Governor in Council, examine every regulation transmitted to the Clerk of the Privy Council for registration pursuant to the Statutory Instruments Act and every Bill introduced in or presented to the House of Commons by a minister of the Crown, in order to ascertain whether any of the provisions thereof are inconsistent with the purposes and provisions of the Canadian Charter of Rights and Freedoms and the Minister shall report any such inconsistency to the House of Commons at the first convenient opportunity”; and

That the Committee report its findings and recommendations to the House of Commons.

At 4:31 p.m., the sitting was suspended.

At 4:33 p.m., the sitting resumed.

The Committee proceeded to the consideration of matters related to Committee business.

The Chair presented the Fourth Report from the Subcommittee on Agenda and Procedure. The Report read as follows:

That the Committee hear witnesses on Bill C-273, An Act to amend the Criminal Code (cyberbullying), Monday, February 25 and Wednesday, February 27, 2013;

That the clause-by-clause consideration of Bill C-273, An Act to amend the Criminal Code (cyberbullying), commence Wednesday, February 27 at 4:30 p.m.;

That the Committee hear witnesses on Bill C-394, An Act to amend the Criminal Code and the National Defence Act (criminal organization recruitment), Monday, March 4 and Wednesday, March 6, 2013;

That the clause-by-clause consideration of Bill C-394, An Act to amend the Criminal Code and the National Defence Act (criminal organization recruitment), commence Wednesday, March 6 at 4:30 p.m.

On motion of Kerry-Lynne D. Findlay, it was agreed, — That the report of the Subcommittee be concurred in.

At 5:06 p.m., the Committee adjourned to the call of the Chair.
