The Standing Committee on Justice and Human Rights met at 11:00 a.m. this day, in Room 268, La Promenade Building, the Chair, Dave MacKenzie, presiding.

 

Members of the Committee present: Françoise Boivin, Kerry-Lynne D. Findlay, Jack Harris, Brian Jean, Dave MacKenzie, Brent Rathgeber, Kyle Seeback and Stephen Woodworth.

 

Acting Members present: Sean Casey for Hon. Irwin Cotler, Mylène Freeman for Charmaine Borg, Jasbir Sandhu for Pierre Jacob and David Wilks for Robert Goguen.

 

In attendance: House of Commons: Wayne Cole, Legislative Clerk. Library of Parliament: Dominique Valiquet, Analyst; Cynthia Kirkby, Analyst.

 

Witnesses: Joy Smith, M.P., Kildonan—St. Paul. Walk With Me: Timea E. Nagy, Program Director, Front Line; Robert Hooper, Chairperson, Board of Directors. Pursuant to the Order of Reference of Monday, December 12, 2011, the Committee commenced consideration of Bill C-310, An Act to amend the Criminal Code (trafficking in persons).
 

The Chair called Clause 1.

 

Joy Smith, Timea E. Nagy, Robert Hooper, Rosalind Prober and Amir Attaran made statements and, with Mark-Erik Hecht and Matthew Taylor, answered questions.

 

The Committee commenced its clause-by-clause study of the Bill.

 

On Clause 1,

Kerry-Lynne D. Findlay moved, — That Bill C-310, in Clause 1, be amended by replacing line 11 on page 1 with the following:

“against section 279.01, 279.011, 279.02 or 279.03 shall be”

 

After debate, the question was put on the amendment of Kerry-Lynne D. Findlay and it was agreed to.

 

Clause 1, as amended, carried.

 

On Clause 2,

Kerry-Lynne D. Findlay moved, — That Bill C-310, in Clause 2, be amended by

(a) replacing lines 29 and 30 on page 1 with the following:

“(2) In determining whether an accused exploits another person under subsection (1), the Court may”

(b) replacing lines 1 to 6 on page 2 with the following:

“(a) used or threatened to use force or another form of coercion;

(b) used deception; or

(c) abused a position of trust, power or authority.”

 

After debate, the question was put on the amendment of Kerry-Lynne D. Findlay and it was agreed to.

 

Clause 2, as amended, carried.

 

The Title carried.

 

The Bill, as amended, carried.

 

ORDERED, — That the Chair report the Bill, as amended, to the House.

 

ORDERED, — That Bill C-310, as amended, be reprinted for the use of the House at report stage.

 

At 1:00 p.m., the Committee adjourned to the call of the Chair.
