The Standing Committee on Access to Information, Privacy and Ethics met in a televised session at 10:02 a.m. this day, in Room 237-C, Centre Block, the Chair, Paul Szabo, presiding.

 

Members of the Committee present: Carole Lavallée, Pat Martin, Richard Nadeau, Paul Szabo and David Tilson.

 

Acting Members present: Dean Del Mastro for Mike Wallace, Rick Dykstra for Dave Van Kesteren, Gary Goodyear for Russ Hiebert, Pierre Lemieux for Dave Batters, Massimo Pacetti for Hon. Charles Hubbard, Marcel Proulx for Glen Douglas Pearson and Hon. Karen Redman for Sukh Dhaliwal.

 

In attendance: Library of Parliament: Nancy Holmes, Analyst. House of Commons: Gregory Tardi, Parliamentary Counsel (Legal).

 

Witnesses: Public Prosecution Service of Canada: Chantal Proulx, Acting Deputy Director of Public Prosecutions; Don Beardall, Senior Counsel. Elections Canada: Marc Mayrand, Chief Electoral Officer; François Bernier, Director, Legal Services.

 
Pursuant to S.O. 108(3)(h)(vi) and the motion adopted by the Committee on June 19, 2008, the Committee resumed its study of the Activities of the Conservative Party of Canada during the 2006 Election Campaign in relation to certain Election Campaign Expenses and the Ethical Standards of Public Office Holders.
 

Karen Redman moved, — That Sam Goldstein be heard following the appearance of the scheduled witnesses.

Debate arose thereon.

 

Pat Martin moved, — That the motion be amended by replacing the words “following the appearance of the scheduled witnesses” with the words “after completion of the days' agenda”.

Debate arose thereon.

 

Dean Del Mastro moved, — That the amendment be amended by replacing all the words after “heard” with the word “immediately”.

 

After debate, the question was put on the subamendment of Dean Del Mastro and it was negatived on the following recorded division: YEAS: Dean Del Mastro, Rick Dykstra, Gary Goodyear, Pierre Lemieux, David Tilson — 5; NAYS: Carole Lavallée, Pat Martin, Richard Nadeau, Massimo Pacetti, Marcel Proulx, Karen Redman — 6.

 

After debate, the question was put on the amendment of Pat Martin and it was agreed to on the following recorded division: YEAS: Carole Lavallée, Pat Martin, Richard Nadeau, Massimo Pacetti, Marcel Proulx, Karen Redman — 6; NAYS: Dean Del Mastro, Rick Dykstra, Gary Goodyear, Pierre Lemieux, David Tilson — 5.

 

After debate, the question was put on the motion, as amended, and it was agreed to on the following recorded division: YEAS: Carole Lavallée, Pat Martin, Richard Nadeau, Massimo Pacetti, Marcel Proulx, Karen Redman — 6; NAYS: Dean Del Mastro, Rick Dykstra, Gary Goodyear, Pierre Lemieux, David Tilson — 5.

 

The motion, as amended, read as follows:

That Sam Goldstein be heard after completion of the days' agenda.

 

Chantal Proulx, duly sworn in, made a statement and with Don Beardall, duly sworn in, answered questions.

 

Marc Mayrand and François Bernier, duly sworn in, answered questions.

 

Dean Del Mastro moved, — That the Committee direct the witnesses to respond to his question.

 

RULING BY THE CHAIR

The Chair ruled the motion out of order as the question was beyond the mandate of the Committee.

 

Whereupon, Dean Del Mastro appealed the decision of the Chair.

The question: "Shall the decision of the Chair be sustained?" was put and the decision was sustained on the following recorded division: YEAS: Carole Lavallée, Pat Martin, Richard Nadeau, Massimo Pacetti, Marcel Proulx, Karen Redman — 6; NAYS: Dean Del Mastro, Rick Dykstra, Gary Goodyear, Pierre Lemieux, David Tilson — 5.

 

Pat Martin moved, — That the Committee suspend for 2 hours following the completion of the current round of questioning.

Debate arose thereon.

 

At 1:34 p.m., the sitting was suspended.

At 3:41 p.m., the sitting resumed.

 

The Committee resumed consideration of the motion of Pat Martin, — That the Committee suspend for 2 hours following the completion of the current round of questioning.

The debate continued.

 

By unanimous consent, the motion was withdrawn.

 

Carole Lavallée moved, — That the Committee proceed to the next order of business.

 

The question was put on the motion and it was agreed to on the following recorded division: YEAS: Carole Lavallée, Pat Martin, Richard Nadeau, Massimo Pacetti, Marcel Proulx, Karen Redman — 6; NAYS: Dean Del Mastro, Rick Dykstra, Gary Goodyear, Pierre Lemieux, David Tilson — 5.

 
The Committee proceeded to the consideration of matters related to Committee business.
 

Carole Lavallée moved, — That the Chair take all necessary actions to schedule, between September 15 and 30, 2008, all of the persons on the Committee approved witness list that have not yet appeared before the Committee and that the Chair provide a weekly report on his endeavours to the Committee members.

Debate arose thereon.

 

Dean Del Mastro moved, — That the motion be amended by replacing all the words following the word “actions” with “to report to the House on September 15, 2008 all of the persons on the Committee-approved witness list who have not yet appeared before the Committee, and that the Chair consult the Speaker of the House for direction”.

 

After debate, the question was put on the amendment of Dean Del Mastro and it was negatived on the following recorded division: YEAS: Dean Del Mastro, Rick Dykstra, Gary Goodyear, Pierre Lemieux, David Tilson — 5; NAYS: Carole Lavallée, Pat Martin, Richard Nadeau, Massimo Pacetti, Marcel Proulx, Karen Redman — 6.
