The Standing Committee on Environment and Sustainable Development met in a televised session at 3:22 p.m. this day, in Room 253-D Centre Block, the Chair, Charles L.Caccia, presiding.

 

Members of the Committee present: Bernard Bigras, Charles L. Caccia, David Chatters, Charles Hubbard, Serge Marcil, Diane Marleau and Bob Mills.

 

Acting Members present: Sue Barnes for Paul Szabo, Claude Drouin for Anita Neville, Alan Tonks for John Godfrey, Paddy Torsney for Anita Neville, Paddy Torsney for Julian Reed and Bryon Wilfert for Stéphane Dion.

 

In attendance: Library of Parliament: Tim Williams, Analyst. House of Commons: Susan Baldwin, Legislative Clerk.

 

Witnesses: Department of the Environment : George Finney, Director, Environmental Conservation Branch, Atlantic Region; Asit Hazra, Chief, Emergencies Prevention Division, Environmental Emergencies Branch, National Programs Directorate, Environmental Protection Service. Department of Justice: Paul Gavrel, Legal Counsel; Michel Arès, Legal Counsel.

 
Pursuant to the Order of Reference of Friday, May 7, 2004, the Committee commenced consideration of Bill C-34, An Act to amend the Migratory Birds Convention Act, 1994 and the Canadian Environmental Protection Act, 1999.
 

The Chair called Clause 1.

 

George Finney made an opening statement and, with the other witnesses, answered questions.

 

The Committee commenced its clause-by-clause study of the Bill.

 

On Clause 1,

Bernard Bigras moved, — That Bill C-34, in Clause 1, be amended by adding after line 21 on page 2 the following:

““federal waters” means, other than in Yukon, waters under the exclusive legislative jurisdiction of Parliament and, in Yukon, waters in a federal conservation area within the meaning of section 2 of the Yukon Act ;”

 

The question was put on the amendment of Bernard Bigras and it was negatived, by a show of hands: YEAS: 2; NAYS: 7.

 

Clause 1 carried on division.

 

Clauses 2 and 3 carried severally.

 

Clauses 4 to 8 inclusive carried on division severally.

 

On Clause 9,

Bob Mills moved, — That Bill C-34, in Clause 9, be amended by replacing line 4 on page 13 with the following:

“not more than $1,000,000 or less than $300,000 or to imprisonment”

 

The question was put on the amendment of Bob Mills and it was negatived, by a show of hands: YEAS: 2; NAYS: 7.

 

Clause 9 carried on division.

 

Clauses 10 to 52 inclusive carried severally.

 

The Title carried.

 

The Bill carried.

 

ORDERED, — That the Chair report the Bill to the House.

 

At 5:24 p.m., the Committee adjourned to the call of the Chair.
