RULING BY THE CHAIR
A question of privilege having been raised by Simon-Pierre Savard-Tremblay, regarding the delay by Canada Border Services Agency to provide documents to the committee, the Chair ruled that the matter relates to privilege.
The committee resumed consideration of the motion of Simon-Pierre Savard-Tremblay moved on Wednesday, October 2, 2024 which read as follows:
Given that
- on March 19 and 21, 2024, the Committee had adopted motions requesting the Border Services Agency to produce, in both official languages, an unredacted copy of several documents concerning the implementation of the CARM system;
- the time allowed to receive these documents has not been respected and the Committee does not have all the necessary information to enable it to make its study in full knowledge of the facts;
- on April 9, 2024, the Committee adopted a unanimous motion indicating that the CBSA had not received the requested documents, and on April 18, 2024, the Committee tabled Report 15 in the House of Commons, in which it is mentioned; and
- as of October 2, 2024, several documents had still not been produced to the Committee, as noted by the CBSA itself in a document received by the Committee on October 1, 2024;
and as the committee has not received all the documents requested, the Committee report these matters to the House, so that the House may take the measures it deems appropriate with regard to parliamentary privilege.
Debate arose thereon.
Maninder Sidhu moved, — That the motion be amended
- by deleting the “and” after “in which it is mentioned;” and
- by deleting everything after “by the Committee on October 1, 2024;” and replacing it with the following:
“- the CBSA continues to provide the committee with the requested documents as they are translated, and, has written to the committee on April 11th, 19th, May 1st, October 1st, and October 7th, requesting guidance from the committee; and
- the CARM technical specifications alone, exceeds 30,000 pages which need to be translated;
That the committee respond to the CBSA’s requests to indicate prioritization of the material to be translated and submitted to the committee”.
After debate, the question was put on the amendment of Maninder Sidhu and it was agreed to on the following recorded division:
YEAS: Richard Cannings, Mona Fortier, Wilson Miao, Churence Rogers, Terry Sheehan, Maninder Sidhu — 6;
NAYS: Tony Baldinelli, Matt Jeneroux, Richard Martel, Simon-Pierre Savard-Tremblay, Ryan Williams — 5.
The motion, as amended, read as follows:
Given that:
