Pursuant to the order of reference of Thursday, October 29, 2020, the committee resumed consideration of Bill C-7, An Act to amend the Criminal Code (medical assistance in dying).

It was agreed, — That the committee continue accepting written submissions on Bill C-7 until the completion of clause-by-clause consideration.

The committee resumed its clause-by-clause study of the Bill.

Randall Garrison moved, — That Bill C-7, in Clause 1, be amended by replacing lines 24 to 32 on page 4 with the following:

“(e) ensure that another medical practitioner or nurse practitioner has provided a written opinion confirming that the person meets all of the criteria set out in subsection (1);

(e.1) if neither they nor the other medical practitioner or nurse practitioner referred to in paragraph (e) has expertise in the condition that is causing the person’s suffering, ensure that they or the medical practitioner or nurse practitioner referred to in paragraph (e) consult with a medical practitioner or nurse practitioner who has that expertise and share the results of that consultation with the other practitioner;”

After debate, the question was put on the amendment of Randall Garrison and it was agreed to on the following recorded division:

Pursuant to the order adopted by the Committee on Thursday, October 15, 2020, the following amendment, submitted by Paul Manly for the consideration of the Committee, was deemed moved:

That Bill C-7, in Clause 1, be amended by replacing lines 40 to 42 on page 4 with the following:

“and palliative care and have had consultations with professionals who have relevant experience and who provide those services or that care;”

“(b.1) on the day specified in the written arrangement referred to in subparagraph (a)(ii), the person is reminded by the medical practitioner or nurse practitioner that they entered into that arrangement and is provided with the opportunity to demonstrate refusal to have the substance administered or resistance to its administration;”

Debate arose thereon.
