Pursuant to the Order of Reference of Monday, December 10, 2018, the Committee resumed consideration of Bill S-240, An Act to amend the Criminal Code and the Immigration and Refugee Protection Act (trafficking in human organs).

The witnesses answered questions.

The Committee commenced its clause-by-clause study of the Bill.

The Chair called Clause 1.

Clause 1 carried.

On Clause 2,

Borys Wrzesnewskyj moved, — That Bill S-240, in Clause 2, be amended by

(a) replacing line 3 on page 2 with the following:

“person from whom it was removed or a person lawfully authorized to consent on behalf of the person from whom it was removed did not give in-”

(b) replacing line 8 on page 2 with the following:

“knowing that the person from whom it was removed or a person lawfully authorized to consent on behalf of the person from whom it was removed”

(c) replacing lines 12 to 15 on page 2 with the following:

“(c) does anything in connection with the removal of an organ from the body of another person on behalf of, at the direction of or in association with the person who removes the organ, knowing that the person from whom it was removed or a person lawfully authorized to consent on behalf of the person from whom it was removed did not give informed consent”

After debate, the question was put on the amendment of Borys Wrzesnewskyj and it was agreed to.

Borys Wrzesnewskyj moved, — That Bill S-240, in Clause 2, be amended by deleting lines 18 to 23 on page 2.

After debate, the question was put on the amendment of Borys Wrzesnewskyj and it was agreed to.

Borys Wrzesnewskyj moved, — That Bill S-240, in Clause 2, be amended by replacing lines 28 to 30 on page 2 with the following:

“person, knowing that it was obtained for consideration for the purposes of exploitation, or being reckless as to whether or not it was obtained for those reasons.”

After debate, by unanimous consent, the amendment was withdrawn.

Raj Saini moved, — That Bill S-240, in Clause 2, be amended by deleting lines 34 to 39 on page 2.

After debate, the question was put on the amendment of Raj Saini and it was agreed to on the following recorded division:

YEAS: Greg Fergus, Raj Saini, Jati Sidhu, Anita Vandenbeld, Borys Wrzesnewskyj — 5;

NAYS: Ziad Aboultaif, Leona Alleslev, Garnett Genuis, Alistair MacGregor — 4.

Clause 2, as amended, carried by a show of hands: YEAS: 6; NAYS: 1.

After debate, Clause 3 carried.

The Title carried.

The Bill, as amended, carried.

ORDERED, — That the Chair report the Bill, as amended, to the House.

At 4:43 p.m., the Committee adjourned to the call of the Chair.
