The Standing Committee on Justice and Human Rights met at 3:29 p.m. this day, in Room 253-D, Centre Block, the Chair, Ed Fast, presiding.

 

Members of the Committee present: Joe Comartin, Bob Dechert, Ed Fast, Hon. Marlene Jennings, Derek Lee, Marc Lemay, Serge Ménard, Brian Murphy, Rick Norlock, Daniel Petit, Brent Rathgeber and Stephen Woodworth.

 

Associate Members present: Bill Siksay.

 

In attendance: Library of Parliament: Robin MacKay, Analyst. House of Commons: Mike MacPherson, Legislative Clerk.

 

Appearing: Hon. Rob Nicholson, Minister of Justice.

 

Witnesses: Department of Justice: Catherine Kane, Director General and Senior General Counsel, Criminal Law Policy Section; John Giokas, Counsel, Criminal Law Policy Section.

 
The Committee proceeded to the consideration of matters related to Committee business.
 

The Chair presented the Fourth Report from the Subcommittee on Agenda and Procedure which read as follows:

Your Subcommittee met on Tuesday, November 2, 2010, to consider the business of the Committee and agreed to make the following recommendations:

1. On Bill S-6

That on Bill S-6, An Act to amend the Criminal Code and another Act (Serious Time for the Most Serious Crime Act) the Committee invite witnesses (to be determined) to appear on Thursday, November 4, 2010, and Tuesday November 16, 2010, subject to their availability; and

That the Committee proceed to clause by clause consideration on Thursday, November 18, 2010.

2. On Bill C-21

That on Bill C-21, An Act to amend the Criminal Code (sentencing for fraud) (Standing up for Victims of White Collar Crime Act) the Committee commence consideration on Tuesday, November 23, 2010, and that witnesses be invited to appear during the first hour; and

That the Committee proceed to clause-by-clause consideration following the witnesses on November 23, 2010 for the second hour.

3. Order in Council

That Susan O’Sullivan, appointed by Order in Council as Federal Ombudsman for Victims of Crime be invited to appear before the Committee on Thursday, November 4, 2010, or Thursday, November 18, 2010, subject to availability.

4. On Bill C-4

That on Bill C-4, An Act to amend the Youth Criminal Justice Act and to make consequential and related amendments to other Acts (Sébastien’s Law (Protecting the Public from Violent Young Offenders)), the Committee resume consideration and invite witnesses (to be determined) to appear on Thursday, November 25, 2010 including the Minister of Justice or his designate to discuss the Comprehensive Review of the Youth Criminal Justice Act, Cross-Country Roundtable Report; and

That Members submit their final list of witnesses for C-4 by Friday, November 5, 2010.

 
Pursuant to the Order of Reference of Wednesday, October 6, 2010, the Committee commenced consideration of Bill S-6, An Act to amend the Criminal Code and another Act.
 

Pursuant to Standing Order 75(1), consideration of Clause 1 is postponed.

The Chair calls Clause 2.

 

The Minister, with the other witnesses, answered questions.

 

At 3:44 p.m., Brian Murphy took the Chair.

At 4:30 p.m., the Chair took the Chair.

 
Pursuant to the Order of Reference of Tuesday, June 8, 2010, the Committee commenced consideration of Bill C-389, An Act to amend the Canadian Human Rights Act and the Criminal Code (gender identity and gender expression).
 

By unanimous consent, it was agreed, — That the Title and Clauses 1 to 5 inclusively of Bill C-389 be adopted severally on divison and that the Chair be ordered to report the Bill to the House.

 

The Bill carried on the following recorded division: YEAS: Joe Comartin, Bob Dechert, Marlene Jennings, Derek Lee, Marc Lemay, Serge Ménard, Brian Murphy, Rick Norlock, Daniel Petit — 9; NAYS: Brent Rathgeber, Stephen Woodworth — 2.

 

ORDERED, — That the Chair report the Bill to the House.
