Pursuant to the order of reference of Wednesday, June 5, 2024, the committee resumed consideration of Bill C-61, An Act respecting water, source water, drinking water, wastewater and related infrastructure on First Nation lands.

Garnett Genuis raised a question of privilege regarding the refusal by the Ministers to provide answers to questions on Monday, October 28, 2024.

RULING BY THE CHAIR

The Chair ruled that the matter does not relate to privilege.

Whereupon, Jamie Schmale appealed the decision of the Chair.

The question: "Shall the decision of the Chair be sustained?" was put and was agreed to on the following recorded division:

YEAS: Jenica Atwin, Jaime Battiste, Ben Carr, Brendan Hanley, Sébastien Lemire, Michael V. McLeod — 6;

NAYS: Lori Idlout, Eric Melillo, Jamie Schmale, Martin Shields, Bob Zimmer — 5.

Accordingly, the Chair's decision was sustained.

Motion

Jamie Schmale moved, — That Minister Hajdu and Minister Vandal be asked to return to the committee within two weeks and for two hours to answer questions, and that, if they do not return as requested, the Chair be instructed to report to the House a recommendation that the Committee be empowered to order the minister’s attendance, from time to time, as it sees fit.

Michael McLeod raised a point of order on the admissibility of the motion.

RULING BY THE CHAIR

The Chair ruled that the motion does not relate to the matter at hand and is therefore not admissible.

Whereupon, Jamie Schmale appealed the decision of the Chair.

The question: "Shall the decision of the Chair be sustained?" was put and was negatived on the following recorded division:

YEAS: Jenica Atwin, Jaime Battiste, Ben Carr, Brendan Hanley, Michael V. McLeod — 5;

NAYS: Lori Idlout, Sébastien Lemire, Eric Melillo, Jamie Schmale, Martin Shields, Bob Zimmer — 6.

Accordingly, the decision of the Chair was overruled.

Debate arose thereon.

Amendment

Bob Zimmer moved, — That the motion be amended by replacing the words “be empowered to” with the words “strongly request”.

Debate arose thereon.

Subamendment

Jenica Atwin moved, — That the amendment be amended by adding after the words "answer questions” the following: “following the conclusion of C-61 legislation at INAN”.

At 9:06 a.m., the meeting was suspended.

At 9:08 a.m., the meeting resumed.

The debate continued.

By unanimous consent, the subamendment of Jenica Atwin was withdrawn.

Subamendment

Ben Carr moved, — That the amendment be amended by adding after the words “answer questions” the words “following the conclusion of C-61 legislation at INAN”, and by deleting the words “and that, if they do not return as request, the Chair be instructed to report to the House a recommendation that the Committee be empowered to order the minister’s attendance, from time to time, as it sees fit”.

After debate, the question was put on the subamendment of Ben Carr and it was negatived on the following recorded division:

YEAS: Jenica Atwin, Jaime Battiste, Ben Carr, Brendan Hanley, Michael V. McLeod — 5;

NAYS: Lori Idlout, Sébastien Lemire, Eric Melillo, Jamie Schmale, Martin Shields, Bob Zimmer — 6.

By unanimous consent, the amendment of Bob Zimmer was withdrawn.

Amendment

Lori Idlout moved, — That the motion be amended by adding after the word “two” the word “sitting” and by deleting the words “and that, if they do not return as request, the Chair be instructed to report to the House a recommendation that the Committee be empowered to order the minister’s attendance, from time to time, as it sees fit”.

The question was put on the amendment of Lori Idlout and it was agreed to on the following recorded division:

The motion, as amended, read as follows:

That Minister Hajdu and Minister Vandal be asked to return to the committee within two sitting weeks and for two hours to answer questions.

It was agreed, — That the committee temporarily delay the start of clause by clause consideration of Bill C-61 to allow for sufficient review of the large number of amendments proposed by all parties and to resume clause by clause consideration on Monday, November 4, 2024.

At 9:57 a.m., the committee adjourned to the call of the Chair.
