MINUTES OF PROCEEDINGS

Meeting No. 5

Tuesday, December 7, 1999

The Standing Committee on Natural Resources and Government Operations met at 11:03 a.m. this day, in Room 209, West Block, the Chair, Joseph Volpe, presiding.

Members of the Committee present: Réginald Bélair, Gilles Bernier, Serge Cardin, Ghislain Lebel, Carolyn Parrish, Carmen Provenzano, Julian Reed, Werner Schmidt, Guy St-Julien, Brent St. Denis and Joseph Volpe.

In attendance: From the Library of Parliament: Jack Stilborn and Grant Purvis, Research Officers.

Witnesses: From the Federation of Canadian Municipalities: Joseph P. Dion, Director of Policy and Public Affairs; John Burrett, Senior Analyst.

Pursuant to its Order of Reference of Tuesday, November 30, 1999, the Committee resumed consideration of Bill C-10, An Act to amend the Municipal Grants Act (See Minutes of Proceedings, Thursday, December 2, 1999, Meeting No. 4).

Joseph Dion made a statement and with John Burrett answered questions.

At 11:38 a.m., the sitting was suspended.

At 11:42 a.m., the sitting resumed.

The Committee proceeded to Clause-by-Clause consideration of the Bill.

Clauses 1 and 2 were allowed to stand.

Clauses 3 to 9 carried.

On Clause 10,

Carolyn Parrish moved, -- That Bill C-10, in Clause 10, be amended by replacing line 16 on page 12 with the following:

"(g.1) providing that, in respect of a taxation year starting on or after January 1, 2000, subsections 3(1.1) and (1.2) and paragraph 3.1(b) apply to corporations included in Schedule III or IV, with any modifications that the circumstances require, in respect of payments in lieu of a real property tax and a frontage or area tax and, in the case of a corporation included in Schedule IV, payments in lieu of a business occupancy tax;

(g.2) providing that section 11.1 applies to"

And the question being put on the amendment, it was agreed to.

Clause 10, as amended, carried.

Clauses 11 to 13 carried.

On Clause 14,

Gilles Bernier moved, -- That Bill C-10, in Clause 14, be amended

(a) by replacing line 9 on page 13 with the following:

"11.1 (1) The Governor in Council shall appoint an"

(b) by replacing, in the English version, line 15 on page 13 with the following:

"further terms. The Governor in Council shall name one of"

(c) by replacing line 36 on page 13 with the following:

"Governor in Council for each day or part of a day that"

And the question being put on the amendment, it was agreed to.

Gilles Bernier moved, -- That Bill C-10, in Clause 14, be amended

(a) by replacing line 13 on page 13 with the following:

"good behaviour for a term not exceeding three years,"

(b) by adding after line 16 on page 13 the following:

"(1.1) A member appointed under subsection (1) may be removed for cause by the Governor in Council."

And the question being put on the amendment, it was agreed to.

Clause 14, as amended, carried.

Clauses 15 to 19 carried.

Clause 2 carried.

Clause 1 carried.

The Bill, as amended, carried.

ORDERED, -- That the Chair report Bill C-10 with amendments to the House as the First Report of the Committee.

It was agreed, -- That the Committee order a reprint of Bill C-10, as amended, for use at Report Stage.

At 11:51 a.m., the Committee adjourned to the call of the Chair.
