Meeting No. 64

Thursday, February 11, 1999

The Standing Committee on Fisheries and Oceans met at 9:12 a.m. this day, in Room 536, Wellington Building, the Chair, Charles Hubbard, presiding.

Members of the Committee present: Yvan Bernier, Claude Drouin, Wayne Easter, Charles Hubbard, Nancy Karetak-Lindell, Gar Knutson, Bill Matthews, Paul Steckle, Peter Stoffer.

Acting Members present: Julian Reed for Lawrence O'Brien; Lynn Myers for Lou Sekora; Daniel Turp for Yves Rocheleau.

In attendance: From the Library of Parliament: Alan Nixon, Research Officer.

Witnesses: From the Department of Fisheries and Oceans Canada: Nadia Bouffard, Senior Advisor, Legal Issues and Canada-France, International Affairs Directorate; Earl Wiseman, Director General, International Affairs Directorate, Fisheries Management; From the Department of Foreign Affairs and International Trade: Howard Strauss, Director, Oceans, Environmental and Economic Law Division.

Pursuant to an Order of Reference of the House dated Tuesday May 5, 1998, the Committee resumed consideration of Bill C-27, An Act to amend the Coastal Fisheries Protection Act and the Canada Shipping Act to enable Canada to implement the Agreement for the Implementation of the Provisions of the United Nations Convention on the Law of the Sea of 10 December 1982 Relating to the Conservation and Management of Straddling Fish Stocks and Highly Migratory Fish Stocks and other international fisheries treaties or arrangements.

The witnesses answered questions.

The Chairman called Clause 5.

After debate, the question being put on the motion.

"Shall Clause 5 stand part of the Bill", it was agreed to, on division.

Clause 5 carried, on division.

The Chairman called Clause 6.

After debate, the question being put on the motion.

"Shall Clause 6 stand part of the Bill", it was agreed to, on division.

Clause 6 carried, on division.

Clause 7 carried, on division.

The Chairman called Clause 9.

After debate, the question being put on the motion.

"Shall Clause 9 stand part of the Bill", it was agreed to, on division.

Clause 9 carried, on division.

Clause 10 carried, on division.

On Clause 11

Wayne Easter moved, - That Clause 11 be amended by replacing, in the English version, lines 16 to 19 on page 8 with the following:

"(2) A fishing vessel on which a summons is served must appear by counsel or agent.

(3) If a fishing vessel"

After debate, the question being put on the amendment, it was agreed to, on division.

Clause 11, as amended, carried on division.

On Clause 12

Daniel Turp moved, - That Clause 12 be amended by replacing, in the French version, lines 34 to 38 on page 8 with the following:

"a.1) soit dans un espace maritime désigné au titre du sous-alinéa 6e)(ii), à bord ou au moyen d'un bateau de pêche d'un État assujetti à l'accord;

a.2) soit dans un espace maritime désigné"

Debate arose thereon.

On motion of Yvan Bernier, it was agreed, - That the amendment be withdrawn.

Clause 12 carried, on division.

Clause 13 carried, on division.

Clause 14 carried, on division.

Clause 15 carried, on division.

The Chairman called Clause 16

After debate, the question being put on the motion.

"Shall Clause 16 stand part of the Bill", it was agreed to, on division.

Clause 16 carried, on division.

Clause 17 carried, on division.

Daniel Turp moved, - That Clauses 1 and 3 which were adopted by the Committee on Tuesday, February 9, 1999 be reopened.

After debate, unanimous consent was refused.

The Title carried, on division.

The Bill, as amended, carried, on division.

On motion of Wayne Easter, it was agreed to, on division, - That the Chairman report Bill C-27, as amended, to the House.

On motion of Wayne Easter, it was agreed to, on division, - That the Committee order a reprint for use at Report Stage.
