MINUTES OF PROCEEDINGS

 

Tuesday, February 10, 1998

 

The Standing Committee on Finance met at 9:03 o’clock a.m. this day in Room 237-C, Centre Block, the Chair, Maurizio Bevilacqua, presiding.

 

Members of the Committee present: Mark Assad, Maurizio Bevilacqua, Scott Brison, Dick Harris, Yvan Loubier, Gary Pillitteri, Karen Redman, Gerry Ritz, Monte Solberg, Paul Szabo, Paddy Torsney and Tony Valeri.

 

. Acting Members present: Odina Desrochers for Gilles Perron; John Finlay for Roger Gallaway; Yvon Godin for Nelson Riis; Stan Keyes for David Iftody and at 10:40 a.m., Randy White for Monte Solberg.

 

In attendance: From the Research Branch, Library of Parliament: Richard Domingue and Marion Wrobel, Research Officers.

 

Witnesses: From the Department of Finance: Leonard L. Farber, Director General, Tax Legislation Division; Peter Gusen, Director, Federal-Provincial Relations Division and Dan MacIntosh, Legislation Coordinator, Tax Legislation Divison

 

In accordance with the Order of Reference from the House of Commons of Wednesday, February 4, 1998, the Committee commenced its examination of Bill C-28, An Act to amend the Income Tax Act, the Income Tax Application Rules, the Bankruptcy and Insolvency Act, the Canada Pension Plan, the Children's Special Allowances Act, the Companies' Creditors Arrangement Act, the Cultural Property Export and Import Act, the Customs Act, the Customs Tariff, the Employment Insurance Act, the Excise Tax Act, the Federal- Provincial Fiscal Arrangements Act, the Income Tax Conventions Interpretation Act, the Old Age Security Act, the Tax Court of Canada Act, the Tax Rebate Discounting Act, the Unemployment Insurance Act, the Western Grain Transition Payments Act and certain Acts related to the Income Tax Act.

 

Peter Gusen made a statement and answered questions.

 

Leonard Farber made a statement and, with the other witnesses, answered questions.

 

Yvon Loubier gave notice that he intended to move five motions related to witnesses for Bill C-28.

 

The Chair ruled the motions in order.

 

Yvon Loubier moved, - That Mr. Howard Wilson, the Government Ethics Counsellor, be called to appear as a witness before the Finance Committee, during its consideration of Bill C-28, in order to clarify section 241 of the Bill sponsored by the Minister of Finance, specifically on the matter of the tax regime for international shipping companies.

 

And debate thereon, the motion carried.

 

Yvon Loubier moved, - That Mr. Raymond Johnston, Chairman of the Canada Steamship Lines Inc., Mr. Pierre Préfontaine, Deputy Chairman of the same company and any other member of the Board of Directors of this business be called to appear as witnesses before the Finance Committee, during its consideration of Bill C-28, in order to clarify Clause 241 of this Bill sponsored by the Minister of Finance, specifically on the matter of the tax regime for international shipping companies.

 

And debate thereon, the motion was negatived.

Yvon Loubier moved, - That the members of the blind trust company (Passage Holding, of Canada Trust) responsible for the Canada Steamship Lines Inc. be called to appear as witnesses before the Finance Committee, during its consideration of Bill C-28, in order to clarify Clause 241 of this Bill sponsored by the Minister of Finance, specifically on the matter of the tax regime for international shipping companies.

 

And debate thereon, the motion was negatived.

Yvon Loubier moved, - That the Hon. Paul Martin, Minister of Finance, be called to appear before the Finance Committee, during it consideration of Bill C-28, in order to clarify Clause 241 of this Bill sponsored by the Minister of Finance, specifically on the matter of the tax regime for international shipping companies.

 

And debate thereon, the motion was negatived.

 

Yeas: 7 Nays 8

 

Yvon Loubier moved, - That, during consideration of Bill C-28 by the Finance Committee, any witness capable of assisting the Committee in clarifying Clause 241 of this Bill, sponsored by the Minister of Finance, specifically on the matter the tax regime for international shipping companies, could be called to appear.

 

And debate thereon, the motion was negative.
