DAILY ROUTINE OF BUSINESS

Tabling of Documents

Pursuant to Standing Order 32(2), Mr. Zed (Parliamentary Secretary to the Leader of the Government in the House of Commons) laid upon the Table, -- Government responses, pursuant to Standing Order 36(8), to the following petitions: (1) No. 352-0862 concerning the income tax system. -- Sessional Paper No. 8545-352-28R; (2) No. 352-0878 concerning Taiwan. -- Sessional Paper No. 8545-352-76B.

Presenting Petitions

Pursuant to Standing Order 36, petitions certified correct by the Clerk of Petitions were presented as follows:

-- by Mrs. Brown (Calgary Southeast), one concerning sex offenders (No. 352-1096);

-- by Mr. Strahl (Fraser Valley East), one concerning sex offenders (No. 352-1097);

-- by Mr. Robinson (Burnaby -- Kingsway), one concerning child labour (No. 352-1098) and one concerning the pharmaceutical industry (No. 352-1099).

Questions on Order Paper

Mr. Zed (Parliamentary Secretary to the Leader of the Government in the House of Commons) presented the answer to question Q-53 on the Order Paper.

GOVERNMENT ORDERS

The Order was read for the consideration at report stage of Bill C-54, An Act to amend the Foreign Extraterritorial Measures Act, as reported by the Standing Committee on Foreign Affairs and International Trade without amendment.

Pursuant to Standing Order 76.1(5), the Speaker selected and grouped for debate the following motions:

    Group No. 1 -- Motions Nos. 1 and 2.
    Group No. 2 -- Motions Nos. 3 to 5.

Group No. 1

Mr. Peters (Secretary of State (International Financial Institutions)) for Mr. Rock (Minister of Justice), seconded by Mr. MacAulay (Secretary of State (Veterans) and Secretary of State (Atlantic Canada Opportunities Agency)), moved Motion No. 1, -- That Bill C-54, in Clause 7, be amended by adding before line 40 on page 3 the following:

      ``7.1 Any judgment given under the law of the United States entitled Cuban Liberty and Democratic Solidarity (LIBERTAD) Act of 1996 shall not be recognized or enforceable in any manner in Canada.''

Mr. Peters (Secretary of State (International Financial Institutions)) for Mr. Rock (Minister of Justice), seconded by Mr. MacAulay (Secretary of State (Veterans) and Secretary of State (Atlantic Canada Opportunities Agency)), moved Motion No. 2, -- That Bill C-54, in Clause 7, be amended by replacing line 24 on page 5 with the following:

    ``judgment has been satisfied outside Canada, or where a judgment has been given under the law of the United States entitled Cuban Liberty and Democratic Solidarity (LIBERTAD) Act of 1996,''.

Debate arose on the motions in Group No. 1.

The question was put on Motion No. 1 and it was agreed to.

Accordingly, Motion No. 2 was also agreed to.

Group No. 2

Mr. Peters (Secretary of State (International Financial Institutions)) for Mr. Rock (Minister of Justice), seconded by Mr. MacAulay (Secretary of State (Veterans) and Secretary of State (Atlantic Canada Opportunities Agency)), moved Motion No. 3 -- That Bill C-54, in Clause 7, be amended by replacing lines 32 and 33 on page 5 with the following:

    ``recover, under the provisions of section 9 that the Attorney General identifies, any or all amounts obtained from that party under the judgment, expenses incurred by that party, or loss or damage suffered by that party.''

Mr. Peters (Secretary of State (International Financial Institutions)) for Mr. Rock (Minister of Justice), seconded by Mr. MacAulay (Secretary of State (Veterans) and Secretary of State (Atlantic Canada Opportunities Agency)), moved Motion No. 4, -- That Bill C-54, in Clause 7, be amended by

    (a) replacing line 4 on page 6 with the following:
      ``by that person under the judgment,''
    (b) replacing line 10 on page 6 with the following:
      ``judicial and extrajudicial costs, and
      (iii) any loss or damages suffered by that party by reason of the enforcement of the judgment; and''
    (c) replacing line 21 on page 6 with the following:
      ``which the judgment was awarded,''
    (d) replacing line 25 on page 6 with the following:
      ``judicial and extrajudicial costs, and
      (iv) such proportion of any loss or damages suffered by that party by reason of the enforcement of the judgment as the Attorney General may specify.''

Mr. Peters (Secretary of State (International Financial Institutions)) for Mr. Rock (Minister of Justice), seconded by Mr. MacAulay (Secretary of State (Veterans) and Secretary of State (Atlantic Canada Opportunities Agency)), moved Motion No. 5, -- That Bill C-54, in Clause 7, be amended by replacing line 7 on page 7 with the following:

    ``is rendered, or any person who controls or is a member of a group of persons that controls, in law''.

Debate arose on the motions in Group No. 2.

The question was put on Motion No. 3 and it was agreed to.

The question was put on Motion No. 4 and it was agreed to.

The question was put on Motion No. 5 and it was agreed to.

Mr. Peters (Secretary of State (International Financial Institutions)) for Mr. Rock (Minister of Justice), seconded by Mr. MacAulay (Secretary of State (Veterans) and Secretary of State (Atlantic Canada Opportunities Agency)), moved, -- That Bill C-54, An Act to amend the Foreign Extraterritorial Measures Act, be concurred in at report stage with amendments.

The question was put on the motion and it was agreed to.

Accordingly, the Bill was concurred in at report stage with amendments and ordered for a third reading at the next sitting of the House.


The Order was read for the second reading and reference to the Standing Committee on Transport of Bill C-58, An Act to amend the Canada Shipping Act (maritime liability).

Mr. Anderson (Minister of Transport), seconded by Mr. Peters (Secretary of State (International Financial Institutions)), moved, -- That the Bill be referred forthwith to the Standing Committee on Transport.

Debate arose thereon.

The question was put on the motion and it was agreed to.

Accordingly, the Bill was referred to the Standing Committee on Transport.


The House resumed consideration of the motion of Mr. Mifflin (Minister of Fisheries and Oceans), seconded by Mr. Marchi (Minister of the Environment), -- That Bill C-26, An Act respecting the oceans of Canada, be now read a third time and do pass;

And of the amendment of Mr. Bernier (Gaspé), seconded by Mr. Fillion (Chicoutimi), -- That the motion be amended by deleting all the words after the word "That" and substituting the following:

    "Bill C-26, An Act respecting the oceans of Canada, be not now read a third time but that it be read a third time this day six months hence."

The debate continued.

And of the amendment of Mr. Bernier (Gaspé), seconded by Mr. Fillion (Chicoutimi).

The question was put on the amendment and, pursuant to Standing Order 45, the recorded division was deferred until Wednesday, October 9, 1996, at the expiry of the time provided for Governement Orders,

The House resumed consideration of the motion of Mr. Marchi (Minister of the Environment), seconded by Mr. Goodale (Minister of Agriculture and Agri-Food), -- That Bill C-29, An Act to regulate interprovincial trade in and the importation for commercial purposes of certain manganese-based substances, be now read a third time and do pass;

And of the amendment of Mrs. Guay (Laurentides), seconded by Mr. Fillion (Chicoutimi), -- That the motion be amended by deleting all the words after the word "That" and substituting the following:

    "Bill C-29, An Act to regulate interprovincial trade in and the importation for commercial purposes of certain manganese-based substances, be not now read a third time but that it be read a third time this day six months hence."

The debate continued.

PRIVATE MEMBERS' BUSINESS

At 5:28 p.m., pursuant to Standing Order 30(6), the House proceeded to the consideration of Private Members' Business.

The Order was read for the second reading and reference to the Standing Committee on Industry of Bill C-311, An Act to amend the Patent Act.

Mr. Solomon (Regina -- Lumsden), seconded by Mr. Robinson (Burnaby -- Kingsway), moved, -- That the Bill be now read a second time and referred to the Standing Committee on Industry.

Debate arose thereon.

Pursuant to Standing Order 96(1), the Order was dropped from the Order Paper.

PROCEEDINGS ON ADJOURNMENT MOTION

At 6:30 p.m., pursuant to Standing Order 38(1), the question "That this House do now adjourn" was deemed to have been proposed.

After debate, the question was deemed to have been adopted.

ADJOURNMENT

At 6:50 p.m., the Speaker adjourned the House until tomorrow at 2:00 p.m., pursuant to Standing Order 24(1).
