The Standing Committee on Government Operations and Estimates met at 8:31 a.m. this day, in Room 112-N, Centre Block, the Chair, Pierre-Luc Dusseault, presiding.

 

Members of the Committee present: Mark Adler, Hon. Gerry Byrne, Anne-Marie Day, Pierre-Luc Dusseault, Jim Hillyer, Pat Martin, Hon. Gordon O'Connor and Bernard Trottier.

 

Acting Members present: Dan Albas for Brad Butt and Mathieu Ravignat for Pat Martin.

 

In attendance: Library of Parliament: Lindsay McGlashan, Analyst; André Léonard, Analyst. House of Commons: Justin Vaive, Legislative Clerk.

 

Witnesses: Treasury Board Secretariat: Michael Vandergrift, Assistant Secretary, Regulatory Affairs.

 
Pursuant to the Order of Reference of Monday, November 17, 2014, the Committee resumed consideration of Bill C-21, An Act to control the administrative burden that regulations impose on businesses.
 

Michael Vandergrift answered questions.

 

The Committee commenced its clause-by-clause study of the Bill.

 

Pursuant to Standing Order 75(1), consideration of the Preamble and Clause 1, Short Title, were postponed.

The Chair called Clause 2.

 

Clause 2 carried.

 

Clause 3 carried.

 

Clause 4 carried.

 

On Clause 5,

Mathieu Ravignat moved, — That Bill C-21, in Clause 5, be amended by adding after line 23 on page 2 the following:

“(1.1) Before the regulation referred to in subsection (1) is made, the interested parties must be provided an opportunity to make representations with respect to the proposed regulation.”

 

After debate, the question was put on the amendment of Mathieu Ravignat and it was negatived, by a show of hands: YEAS: 1; NAYS: 5.

 

Clause 5 carried.

 

Clause 6 carried.

 

On Clause 7,

Mathieu Ravignat moved, — That Bill C-21, in Clause 7, be amended by adding after line 13 on page 3 the following:

“(2) Regulations relating to public health, food security, occupational health and safety, and the environment are exempt from the provisions of section 5.”

 

After debate, the question was put on the amendment of Mathieu Ravignat and it was negatived, by a show of hands: YEAS: 2; NAYS: 5.

 
Mathieu Ravignat moved, — That Bill C-21, in Clause 7, be amended by adding after line 13 on page 3 the following:

“(2) Regulations relating to safety management systems, transportation safety and transportation security are exempt from the provisions of section 5.”

 

After debate, the question was put on the amendment of Mathieu Ravignat and it was negatived, by a show of hands: YEAS: 3; NAYS: 6.

 

By unanimous consent, it was agreed, — That the result of the vote on the previous amendment be applied to the following seven (7) amendments which are therefore also negatived:

That Bill C-21, in Clause 7, be amended by adding after line 13 on page 3 the following:

“(2) Regulations relating to public health are exempt from the provisions of section 5.”

That Bill C-21, in Clause 7, be amended by adding after line 13 on page 3 the following:

“(2) Regulations relating to food security are exempt from the provisions of section 5.”

That Bill C-21, in Clause 7, be amended by adding after line 13 on page 3 the following:

“(2) Regulations relating to occupational health and safety are exempt from the provisions of section 5.”

That Bill C-21, in Clause 7, be amended by adding after line 13 on page 3 the following:

“(2) Regulations relating to the environment are exempt from the provisions of section 5.”

That Bill C-21, in Clause 7, be amended by adding after line 13 on page 3 the following:

“(2) Regulations relating to safety management systems are exempt from the provisions of section 5.”

That Bill C-21, in Clause 7, be amended by adding after line 13 on page 3 the following:

“(2) Regulations relating to transportation security are exempt from the provisions of section 5.”

That Bill C-21, in Clause 7, be amended by adding after line 13 on page 3 the following:

“(2) Regulations relating to transportation safety are exempt from the provisions of section 5.”

 

Clause 7 carried by a show of hands: YEAS: 5; NAYS: 2.

 

Clause 8 carried by a show of hands: YEAS: 5; NAYS: 2.

 

On Clause 9,

Mathieu Ravignat moved, — That Bill C-21, in Clause 9, be amended by adding after line 25 on page 3 the following:

“(2) The report must contain the following information:

(a) a list of the regulations that have been made and repealed pursuant to section 5 during the year;

(b) a summary of the impact of each repeal of a regulation, taking into account the economic, social and environmental factors;

(c) the expected and net effects for each repealed regulation; and

(d) a description of the consultations held during the repeal process.”

 

After debate, the question was put on the amendment of Mathieu Ravignat and it was negatived, by a show of hands: YEAS: 3; NAYS: 5.

 

Clause 9 carried by a show of hands: YEAS: 5; NAYS: 3.

 

Clause 10 carried by a show of hands: YEAS: 5; NAYS: 2.

 

Clause 11 carried.

 

Clause 1, Short Title, carried.

 

The Preamble carried by a show of hands: YEAS: 5; NAYS: 3.

 

The Title carried.

 

The Bill carried by a show of hands: YEAS: 5; NAYS: 3.
