Presenting Reports from Inter-parliamentary Delegations

Pursuant to Standing Order 34(1), Mr. Graham (Toronto Centre -- Rosedale) presented the report of the Canadian delegation to the meeting of the Parliamentary Assembly of the Organization on Security and Cooperation in Europe (OSCE) held in Warsaw, Poland, from July 5 to 9, 1997. -- Sessional Paper No. 8565-361-61.

Presenting Reports from Committees

Mr. Graham (Toronto Centre -- Rosedale), from the Standing Committee on Foreign Affairs and International Trade, presented the 1st Report of the Committee (5th and 7th Reports of the 2nd Session, 35th Parliament). -- Sessional Paper No. 8510-361-3.

Mr. St-Julien (Abitibi), from the Standing Committee on Aboriginal Affairs and Northern Development, presented the 1st Report of the Committee (Bill C-8, An Act respecting an accord between the Governments of Canada and the Yukon Territory relating to the administration and control of and legislative jurisdiction in respect of oil and gas, without amendment). -- Sessional Paper No. 8510-361-6.

Introduction of Private Members' Bills

Pursuant to Standing Orders 68(2) and 69(1), on motion of Mr. Reynolds (West Vancouver -- Sunshine Coast), seconded by Mr. White (North Vancouver), Bill C-275, An Act to amend the Privacy Act, was introduced, read the first time, ordered to be printed and ordered for a second reading at the next sitting of the House.


Pursuant to Standing Orders 68(2) and 69(1), on motion of Ms. Davies (Vancouver East), seconded by Mr. Riis (Kamloops), Bill C-276, An Act to amend the Criminal Code (protection of children), was introduced, read the first time, ordered to be printed and ordered for a second reading at the next sitting of the House.

Motions

By unanimous consent, Mr. Adams (Parliamentary Secretary to the Leader of the Government in the House of Commons), seconded by Ms. Minna (Beaches -- East York), moved,

-- That the 7th Report of the Standing Committee on Procedure and House Affairs, presented earlier today, be concurred in.

The question was pout on the motion and it was agreed to.


By unanimous consent, it was ordered, -- That ten members of the Standing Committee on Fisheries and Oceans be authorized to travel to St. John's, Witless Bay, Harbour Breton, Marystown, Burgeo, Deer Lake, La Scie, Blanc Sablon, Îles-de-la-Madeleine, Miramichi, Shelburne and Sambro for the week of November 23-30, 1997, and that the necessary staff do accompany the members of the Committee.

GOVERNMENT ORDERS

Ms. McLellan (Minister of Justice), seconded by Mr. Kilgour (Secretary of State (Latin America and Africa)), moved, --

    That a Special Joint Committee of the Senate and the House of Commons be appointed to examine and analyze issues relating to custody and access arrangements after separation and divorce, and in particular, to assess the need for a more child-centred approach to family law policies and practices that would emphasize joint parental responsibilities and child-focused parenting arrangements based on children's needs and best interests;
    That seven Members of the Senate and sixteen Members of the House of Commons be members of the Committee with two Joint Chairpersons;
    That changes in the membership, on the part of the House of Commons of the Committee, be effective immediately after a notification signed by the member acting as the chief Whip of any recognized party has been filed with the clerk of the Committee;
    That the Committee be directed to consult broadly, examine relevant research studies and literature and review models being used or developed in other jurisdictions;
    That the Committee have the power to sit during sittings and adjournments of the Senate;
    That the Committee have the power to report from time to time, to send for persons, papers and records, and to print such papers and evidence as may be ordered by the Committee;
    That the Committee have the power to retain the services of expert, professional, technical and clerical staff, including legal counsel;
    That a quorum of the Committee be twelve members whenever a vote, resolution or other decision is taken, so long as both Houses are represented, and that the Joint Chairpersons be authorized to hold meetings, to receive evidence and authorize the printing thereof, whenever six members are present, so long as both Houses are represented;
    That the Committee be empowered to appoint, from among its members, such sub-committees as may be deemed advisable, and to delegate to such sub-committees, all or any of its power, except the power to report to the Senate and House of Commons;
    That the Committee be empowered to adjourn from place to place within and outside Canada;
    That the Committee be empowered to authorize television and radio broadcasting of any or all of its proceedings;
    That the Committee present its final report no later than November 30, 1998; and
    That a Message be sent to the Senate to acquaint that House accordingly. (Government Business No. 7)

Debate arose thereon.

MOTIONS

By unanimous consent, it was ordered, -- That, notwithstanding any Standing Order, if Bill C-16, An Act to amend the Criminal Code and the Interpretation Act (powers to arrest and enter dwellings), has been reported from committee no later than November 6, 1997, the House may consider the said Bill at the report stage and at the third reading stage on November 7, 1997.

GOVERNMENT ORDERS

Pursuant to Order made earlier today, the question was deemed put on the motion and a recorded division was deemed demanded and deferred until Tuesday, November 18, 1997, at the expiry of the time provided for Government Orders.


The Order was read for the second reading and reference to the Standing Committee on Health of Bill C-14, An Act respecting the safety and effectiveness of materials that come into contact with or are used to treat water destined for human consumption.

Mr. Mifflin (Minister of Veterans Affairs) for Mr. Rock (Minister of Health), seconded by Mr. Kilgour (Secretary of State (Latin America and Africa)), moved, -- That the Bill be now read a second time and referred to the Standing Committee on Health.

PRIVATE MEMBERS' BUSINESS

At 5:30 p.m., pursuant to Standing Order 30(6), the House proceeded to the consideration of Private Members' Business.

The Order was read for the second reading and reference to the Standing Committee on Justice and Human Rights of Bill C-209, An Act to amend the Criminal Code (joyriding).

Mr. Strahl (Fraser Valley), seconded by Mr. Epp (Elk Island), moved, -- That the Bill be now read a second time and referred to the Standing Committee on Justice and Human Rights.

Debate arose thereon.

Pursuant to Standing Order 96(1), the Order was dropped from the Order Paper.

MESSAGES FROM THE SENATE

A message was received from the Senate as follows:

-- ORDERED: That a Message be sent to the House of Commons to acquaint that House that the Senate do unite with the House of Commons in the appointment of a Special Joint Committee of the Senate and the House of Commons to consider matters related to the proposed resolution respecting a proposed Amendment to Term 17 of the Terms of Union of Newfoundland with Canada concerning the Newfoundland school system;

      That seven Members of the Senate and sixteen Members of the House of Commons be members of the Committee;
      That the Members to act on behalf of the Senate be the Honourable Senators Doody, Fairbairn, Gigantès, Kinsella, Murray, Pearson and Rompkey
      That the Committee be directed to consult broadly and review such information as it deems appropriate with respect to this issue;
      That the Committee have the power to sit during sittings and adjournments of the Senate;
      That the Committee have the power to report from time to time, to send for persons, papers, and records, and to print such papers and evidence as may be ordered by the Committee;
      That the Committee have the power to hear witnesses via video conferencing;
      That the Committee have the power to retain the services of expert, professional technical and clerical staff;
      That the quorum of the Committee be twelve members, whenever a vote, resolution or other decision is taken, so long as both Houses are represented, and that the Joint Chairpersons be authorized to hold meetings, to receive evidence and authorize the printing thereof, whenever six members are present, so long as both Houses are represented;
      That the Committee have the power to appoint, from among its members, such sub-committees as may be deemed advisable, and to delegate to such sub- committees all or any of its powers except the power to report to the Senate and the House of Commons;
      That the Committee have the power to authorize television and radio broadcasting of any or all of its proceedings;
      That the Committee present its final report no later than December 5, 1997; and
      That, notwithstanding usual practices, if the House or the Senate are not sitting when the final report of the Committee is completed, the report may be deposited with the Clerk of the House which is not sitting, and or the Clerks of both Houses if neither House is then sitting, and the report shall thereupon be deemed to have been presented in that House, or both Houses, as the case may be.
