Minutes of Proceedings
The Chair presented the Second Report from the Subcommittee on Agenda and Procedure. The Report was concurred in and reads as follows:
Your Subcommittee met on Monday, May 9, 2016, to consider the business of the Committee and agreed to make the following recommendations:
1. That the Chair write to the Standing Committee on Human Resources, Skills and Social Development and the Status of Persons with Disabilities, recommending that they undertake a study of the benefits and impacts of a guaranteed minimum income system;
2. That the motion of Steven MacKinnon, put on notice on Friday, May 6, 2016, be amended by replacing, in (b), the words “Friday, May 27” by the words “Thursday, May 26” and that the Committee adopt the amended motion;
The amended motion would read as follows:
That the Committee, in its consideration of the Bill C-15, An Act to implement certain provisions of the budget tabled in Parliament on March 22, 2016 and other measures proceed as follows:
(a) that the Committee proceed with the clause-by-clause consideration of Bill C-15 no later than Tuesday, May 31, 2016, provided that the Chair may limit debate on each clause to a maximum of five minutes per party, per clause;
(b) that amendments be submitted to the Clerk of the Committee no later than noon on Thursday, May 26, 2016 and distributed to members in both official languages; and
(c) that if the Committee has not completed the clause-by-clause consideration of Bill C-15 by 11:00 p.m. on Tuesday May 31, 2016, all remaining amendments submitted to the Committee shall be deemed moved, the Chair shall put the question, forthwith and successively, without further debate on all remaining clauses and amendments submitted to the Committee, as well as each and every question necessary to dispose of clause-by-clause consideration of the Bill, as well as all questions necessary to report the Bill to the House and to order the Chair to report the Bill to the House as early as possible.
3. That, in relation to the Committee’s study of Bill C-15, the Committee adopt the following sitting schedule, with all meetings televised when possible:
Thursday, May 12, from 11:00 a.m. to 2:00 p.m. – 12 witnesses;
Tuesday, May 17, from 11:00 a.m. to 2:00 p.m. – 12 witnesses;
Wednesday, May 18, from 3:30 to 6:30 p.m. – 12 witnesses;
Monday, May 30, from 3:30 until 8:00 p.m. – That the Committee hear from the Honourable Minister of Finance from 3:30 to 4:30 p.m. and that the Committee commence clause-by-clause consideration of the Bill from 4:30 to 8:00 p.m., unless the House of Commons undertakes the consideration of the Main Estimates 2016-17 under Finance in Committee of the Whole that evening, in which case the Finance Committee shall adjourn its meeting at 5:30 p.m.;
Tuesday, May 31, from 10:00 a.m. to 2:00 p.m. – That the Committee continue clause-by-clause consideration of Bill C-15;
Tuesday, May 31, from 3:30 p.m. – That the Committee continue and complete clause-by-clause consideration of Bill C-15.
4. That, in relation to the Committee’s study of Bill C-15, the Clerk distribute to all Members the complete list of potential witnesses, and that the Committee decide on the final list of witnesses to be invited during its meeting on Tuesday, May 10.
Steven MacKinnon moved, — That, in relation to Orders of Reference from the House respecting Bills,
(a) the Clerk of the Committee shall, upon the Committee receiving such an Order of Reference, write to each Member who is not a member of a caucus represented on the Committee to invite those Members to file with the Clerk of the Committee, in both official languages, any amendments to the Bill, which is the subject of the said Order, which they would suggest that the Committee consider;
(b) suggested amendments filed, pursuant to paragraph (a), at least 48 hours prior to the start of clause-by-clause consideration of the Bill to which the amendments relate shall be deemed to be proposed during the said consideration, provided that the Committee may, by motion, vary this deadline in respect of a given Bill; and
(c) during the clause-by-clause consideration of a Bill, the Chair shall allow a Member who filed suggested amendments, pursuant to paragraph (a), an opportunity to make brief representations in support of them.
After debate, the question was put on the motion and it was agreed to, by a show of hands: YEAS: 5; NAYS: 1.
Trevor McGowan, Brad Recker, Faith McIntyre and Glenn R. Campbell made statements, and with Pierre Leblanc, James R. Greene, Robert Demeter, Greg Meredith, Margaret Tepczynska, Dan Robinson and Alexandra Dostal, answered questions.
At 12:35 p.m. Ron Liepert took the Chair.
At 12:47, Wayne Easter took the Chair.
It was agreed, — That each party submit their top 5 witnesses for Bill C-15, An Act to implement certain provisions of the budget tabled in Parliament on March 22, 2016 and other measures, to the Clerk before the end of the meeting.
The Committee resumed consideration of the motion of Pierre-Luc Dusseault, which reads as follows: - That the committee compel the Canada Revenue Agency to provide all written correspondence –including, but not limited to letters and emails, between the Canada Revenue Agency and the KPMG s.r.l. accounting firm, issued between January 1 1999 and May 5 2016, regarding the Isle of Man tax plan and any matters related to that plan, and that the documents be provided to the committee no later than Wednesday May 18, 2016
It was agreed, — That the motion be amended by replacing the word “compel” with the word “request” and by inserting the words “that is not subject to section 241 of the Income Tax Act” after the words “that plan” .
Francesco Sorbara moved, — That the motion be amended by replacing the words “no later than Wednesday May 18th, 2016” with the words “at the earliest possible date”.
Debate arose thereon.
After debate, the question was put on the amendment of Francesco Sorbara and it was agreed to, by a show of hands: YEAS: 5; NAYS: 4.
On motion of Guy Caron, it was agreed, — That the motion be amended by adding the following words after the word “date”: “provided that the CRA forward to the Committee any information when it is found”.
The motion, as amended was agreed to, and now reads as follows:
That the committee request the Canada Revenue Agency to provide all written correspondence –including, but not limited to letters and emails, between the Canada Revenue Agency and the KPMG s.r.l. accounting firm, issued between January 1st 1999 and May 5th 2016, regarding the Isle of Man tax plan and any matters related to that plan, that is not subject to section 241 of the Income Tax Act, and that the documents be provided to the committee at the earliest possible date, provided that the CRA forward to the Committee any information when it is found.
On motion of Lisa Raitt, it was agreed, — That the Committee invite the Honourable Bill Morneau, Minister of Finance, and officials from the Department of Finance, to appear as a witness for the Committee’s deliberations on Bill C-15, An Act to implement certain provisions of the budget tabled in Parliament on March 22nd, 2016 and other measures.
It was agreed, — That the evidence and documentation received during today’s Committee meeting in relation to its subject matter study of Bill C-15 be deemed received by the Committee in the context of its legislative study of Bill C-15.
At 2:00 p.m., the Committee adjourned to the call of the Chair.
