Study on Bill C-27, The Electronic Commerce Protection Act

Ottawa, June 19, 2009 -

On June 9, 2009, the House of Commons Standing Committee on Industry, Science and Technology began its study of Bill C-27, An Act to promote the efficiency and adaptability of the Canadian economy by regulating certain activities that discourage reliance on electronic means of carrying out commercial activities, and to amend the Canadian Radio-television and Telecommunications Commission Act, the Competition Act, the Personal Information Protection and Electronic Documents Act and the Telecommunications Act. This bill was referred to the Committee after its second reading in the House of Commons on May 8, 2009.

The Committee believes that it is important to hear from Canadians on this topic. Its aim is to hear witnesses representing a variety of sectors and regions within Canada. The Committee will also accept written briefs on this topic from groups and individuals who will not have the opportunity to appear before the Committee.

The Committee welcomes briefs on any aspect of Bill C-27, including but not limited to:

  • Its regulation of electronic threats such as spam, phishing, malware, spyware, hacking and unauthorized conversion of personal computers into zombies;
  • The role of the proposed legislation in preventing identity theft;
  • The proposed enforcement scheme and the roles of the Canadian Radio-television and Telecommunications Commission, the Competition Bureau and the Privacy Commissioner of Canada;
  • The private right of action proposed in the bill;
  • The administrative penalties proposed in the bill;
  • The implementation of the consent requirements in the bill by businesses and organizations;
  • The future of the Do Not Call List.

Individuals and organisations wishing to appear on this bill may send their request in writing to the Committee’s mailbox at INDU@parl.gc.ca or to the mailing address below.

Individuals and organisations wishing to present a written brief to the Committee on Bill C-27 may send their brief (maximum of 5 pages in length) to the Committee’s mailbox at INDU@parl.gc.ca or to the mailing address below by no later than 15 August 2009.

At the conclusion of the study, the Committee will report to the House of Commons.
