Motions Respecting Senate Amendments to Bills |
Motions relatives aux amendements du Sénat à des projets de loi |
February 6, 2008 — Resuming consideration of the motion of Mr. Nicholson (Minister of Justice and Attorney General of Canada), seconded by Mr. Hill (Secretary of State), — That a message be sent to the Senate to acquaint their Honours that this House: | 6 février 2008 — Reprise de l’étude de la motion de M. Nicholson (ministre de la Justice et procureur général du Canada), appuyé par M. Hill (secrétaire d'État), — Qu’un message soit envoyé au Sénat afin d’informer leurs Honneurs que cette Chambre : |
agrees with amendments numbered 2, 4, 5 and 6 made by the Senate to Bill C-13, An Act to amend the Criminal Code (criminal procedure, language of the accused, sentencing and other amendments); but | accepte les amendements nos 2, 4, 5 et 6 apportés par le Sénat au projet de loi C-13, Loi modifiant le Code criminel (procédure pénale, langue de l'accusé, détermination de la peine et autres modifications); |
disagrees with amendment numbered 1 because it would place an undue burden on judges and does not take into consideration provincial and territorial practices that are currently in place to ensure that accused persons are informed of their language rights; and | rejette l’amendement no 1 parce qu’il imposerait un fardeau indu aux juges et ne tiendrait pas compte des pratiques mises en place par les provinces et les territoires afin d’aviser les accusés de leurs droits linguistiques; |
disagrees with amendment numbered 3 because the Minister of Justice would be unable to comply with the statutory duty imposed by the amendment as provinces and territories do not keep statistics to report on the operation of the language of trial provisions; | rejette l’amendement no 3, car le ministre de la Justice ne serait pas en mesure de se conformer à l’exigence prévue par cet amendement, du fait que les provinces et les territoires ne compilent aucune statistique sur la mise en oeuvre des dispositions liées à la langue du procès; |
And of the amendment of Mr. Murphy (Moncton—Riverview—Dieppe), seconded by Mr. LeBlanc (Beauséjour), — That the motion be amended by deleting the words “agrees with amendments numbered 2, 4, 5 and 6” and substituting therefore the words “agrees with amendments numbered 1, 2, 4, 5 and 6” and by deleting the paragraph commencing with the words “disagrees with amendment numbered 1”. |
