MINUTES OF PROCEEDINGS

Meeting No. 67

Tuesday, May 28, 2002

The Standing Committee on Canadian Heritage met in camera session at 9:10 a.m. this day, in Room 237-C, Centre Block, the Chair, Clifford Lincoln, presiding.

Members of the Committee present: Jim Abbott, Sarmite Bulte, Rodger Cuzner, Claude Duplain, Christiane Gagnon, John Harvard, Betty Hinton, Wendy Lill, Clifford Lincoln, Dennis Mills and Tony Tirabassi.

Acting Members present: Larry Bagnell for Paul Bonwick, Nancy Karetak-Lindell for Roger Gallaway, Shawn Murphy for Roger Gallaway, Nick Discepola for Tony Tirabassi and Brian Pallister for Chuck Strahl.

In attendance: From the Library of Parliament: Alan Cofman, intern; Joseph Jackson, Sam Banks and Terrence Thomas, research officers.  Consultant:  David Black.  Jean-Michel Roy, Legislative Clerk.

Witnesses: From the Department of Canadian Heritage: Marc O'Sullivan, Director General, Broadcasting Policy and Innovation; Mario Lepage, Counsel.

In accordance with its mandate under Standing Order 108(2), the Committee proceeded to discuss its future business.

It was agreed, - That, in relation to Bill C-48, An Act to amend the Copyright Act, the Ministers of Canadian Heritage and Industry be invited to appear before the Committee following hearings with departmental officials and witnesses.

At 9:55 a.m., the Committee proceeded to sit in a televised session.

Pursuant to its Order of Reference of Tuesday, February 5, 2002, the Committee resumed consideration of Bill S-7, An Act to amend the Broadcasting Act (See Minutes of Proceedings, Wednesday, April 10, 2002, Meeting No. 48).

The Committee proceeded to Clause-by-Clause consideration of the Bill.

On Clause 1

John Harvard moved, - That Bill S-7, in Clause 1, be amended by adding after line 13 on page 1 the following:

“(3) Subsections (1) and (2) do not apply to licensees who are not required to pay licence fees under the Broadcasting Licence Fee Regulations, 1997”

RULING BY THE CHAIR

The proposed amendment is inadmissible as it goes beyond the scope of the Bill.

Whereupon, John Harvard appealed the decision of the Chair.

The question “Shall the decision of the Chair be sustained?” was put and the decision was overturned, by a show of hands:

YEAS:  2                     NAYS: 7

Accordingly, debate arose on the amendment of John Harvard:

That Bill S-7, in Clause 1, be amended by adding after line 13 on page 1 the following:

“(3) Subsections (1) and (2) do not apply to licensees who are not required to pay licence fees under the Broadcasting Licence Fee Regulations, 1997”

Sarmite Bulte moved, - That the motion be amended by inserting, after “licencees”, the words “other than the Corporation, licencees carrying on programming activities on behalf Her Majesty in right of a province and native broadcasting undertaking”

Debate arose thereon

Claude Duplain moved, - That consideration of the Bill be suspended.

After debate, the motion was agreed to by a show of hands.

YEAS:  7                     NAYS:  5

Dennis Mills moved, - That, pursuant to Standing Order 97.1, the Chair present a report to the House requesting a single extension of thirty sitting days to consider the Bill.

After debate, the motion was agreed to by a show of hands.

YEAS:  6                     NAYS:  2

At 11:35 a.m., the Committee adjourned to the call of the Chair.
