Meeting No. 19

Thursday, November 25, 1999

The Standing Committee on Aboriginal Affairs and Northern Development met at 3:30 p.m. this day, in Room 269, West Block, the Chair, Sue Barnes, presiding.

Members of the Committee present: Claude Bachand, Sue Barnes, Ray Bonin, Ghislain Fournier, Ivan Grose, David Iftody, Nancy Karetak-Lindell, Gerald Keddy, Derrek Konrad, John O'Reilly, Mike Scott, Guy St-Julien.

Acting Member present: Lynn Myers for John Finally; Maurice Vellacott for Jim Gouk; Pat Martin for Louise Hardy.

In attendance: From the Library of Parliament: : Mary Hurley ; Tonina Simeone, Research Officers.

Witnesses: From the Department of Indian Affairs and Northern Development: Tom Molloy, Chief Federal Negotiator; John Watson, Regional Director General, British Columbia Region.

Pursuant to its Order of Reference of Monday, November 1st, 1999, the Committee resumed consideration of Bill C-9, An Act to give effect to the Nisga'a Final Agreement (See Minutes of Proceedings, Wednesday, November 3, 1999, Meeting No. 3).

The Committee proceeded to clause-by-clause consideration of the Bill.

It was agreed, -That five minutes be allowed for each party on each issue.

Clauses 2 to 4 inclusive carried.

Clause 5 stood.

Clauses 6 to 10 inclusive carried.

Clause 11 stood.

Clauses 12 to 27 inclusive carried.

Clause 1 carried.

With unanimous consent, the Committee resumed consideration of Clause 5.

Derrek Konrad moved, - That Bill C-9, in Clause 5, be amended by replacing lines 15 and 16 on page 3 with the following:

"The Nisga'a Final Agreement is binding on all persons."

After debate, the question being put on the amendment, it was negatived on a recorded division:

"Agreement and including any amendments made to that Agreement from time to time"
