The Standing Committee on Justice and Human Rights met at 3:30 o’clock p.m. this day, in Room 536, Wellington Building, the Chair, Shaughnessy Cohen, presiding.

Members of the Committee present: Eleni Bakopanos, Michel Bellehumeur, Garry Breitkreuz, Shaughnessy Cohen, Paul E. Forseth, Derek Lee, John Maloney, Peter G. MacKay Gurbax Malhi, Richard Marceau and Jack Ramsay.

Acting Members present: Bob Kilger for Paul DeVillers, John Richardson for Nick Discepola, Stan Dromisky for Sheila Finestone, Gar Knutson for John Maloney, Paul Bonwick for Andrew Telegdi, Colleen Beaumier for Andrew Telegdi, Chuck Stralh for Garry Breitkreuz, Pat Martin for Peter Mancini and Mark Muise for Peter G. MacKay.

In attendance: From the Research Branch of the Library of Parliament: Philip Rosen, Senior Analyst and Marilyn Pilon, Research Officer.

Appearing: The Hon. Anne McLellan, Minister of Justice and Attorney General of Canada.

Witnesses: From the Department of Justice: Yvan Roy, Senior General Counsel. From the Canadian Police Association: Neal Jessop, President; Scott Newark, Executive Officer.

The Order of Reference dated Friday, October 31, 1997, being read as follows :

ORDERED,--That Bill C-16, An Act to amend the Criminal Code and the Interpretation Act (powers to arrest and enter dwellings), be now read a second time and referred to the Standing Committee on Justice and Human Rights.

The Chair called Clause 1.

The Minister made a statement and, with Yvan Roy, answered questions.

Neal Jessop and Scott Newark made a presentation and answered questions.

Jack Ramsay moved,--"That the Standing Committee on Justice and Human Rights request the Minister of Justice ask the Supreme Court of Canada to extend the six-month period of suspension to allow the Committee sufficient time to fully examine Bill C-16."

After debate, the question being put on the motion, it was negatived on the following division:
