MINUTES OF PROCEEDINGS

Meeting No. 111

Thursday, April 15, 1999

The Standing Committee on Industry met at 9:12 a.m. this day, in Room 536, Wellington Building, the Chair, Susan Whelan, presiding.

Members of the Committee present: Sue Barnes, Eugène Bellemare, Antoine Dubé, Rahim Jaffer, Marlene Jennings, Jim Jones, Stan Keyes, Francine Lalonde, Walt Lastewka, Ian Murray, Jim Pankiw, Janko Peric and Susan Whelan.

Acting Members present: Gary Pillitteri for Alex Shepherd, Paul Forseth for Eric Lowther, John Solomon for Chris Axworthy.

Other Members present: Ray Bonin and Dan McTeague.

In attendance: From Committees and Legislative Services Directorate: Susan Baldwin, Legislative Clerk. From the Library of Parliament: Antony Jackson and David Johansen, Research Officers.

Witnesses: As Individual: Dan McTeague, Member of Parliament; Michael Kelen, Barrister and Solicitor. From the Competition Bureau: Konrad von Finckenstein, Commissioner of Competition; Harry Chandler, Deputy Commissioner of Competition, Criminal Matters; Don Mercer, Head, Amendments Unit.

Pursuant to an Order of Reference of the House dated Tuesday, October 20, 1998, consideration of Bill C-235, An Act to amend the Competition Act (protection of those who purchase products from vertically integrated suppliers who compete with them at retail).

Dan McTeague and Michael Kelen made an opening statement and answered questions.

Konrad von Finckenstein made an opening statement and with the witnesses, answered questions.

At 10:36 a.m., the Committee proceeded to Clause-by-Clause consideration of the Bill.

On Clause 1

Marlene Jennings moved, - That Bill C-235, in Clause 1, be amended by replacing lines 1 to 9 on page 2 with the following:

"(a) the vertically integrated supplier's own retail price in the same market area, or"

The question being put on the amendment, it was negatived on the following recorded division:

By unanimous consent, it was agreed, - That the results of the vote on Clause 1 be applied to the votes on Clause 2 and the Title.

Accordingly, Clause 2 was negatived on division.

Accordingly, the Title was negatived on division.

Walt Lastewka moved, - That the Committee recommend to the House that Bill C-235 not be further proceeded with.

At 11:01 a.m., the sitting was suspended.

At 11:04 a.m., the sitting resumed.

By unanimous consent, the motion was withdrawn.

Ordered, - That the Chair be instructed to report Bill C-235 back to the House with amendments.

At 11:12 a.m., the Committee adjourned to the call of the Chair.
