The Standing Committee on Canadian Heritage met at 3:52 p.m. this day, in Room 112-N, Centre Block, the Chair, the Hon. Rob Moore, presiding.

 

Members of the Committee present: Ray Boughen, Marjolaine Boutin-Sweet, Gordon Brown, Paul Calandra, Andrew Cash, Matthew Dubé, Jim Hillyer, Hon. Rob Moore, Pierre Nantel, Blake Richards, Scott Simms and Terence Young.

 

Acting Members present: Merv Tweed for Gordon Brown.

 

Other Members present: Elizabeth May and Louis Plamondon.

 

In attendance: Library of Parliament: Michael Dewing, Analyst; Marion Ménard, Analyst.

Pursuant to the Order of Reference of Wednesday, May 29, 2013, the Committee commenced consideration of Bill C-49, An Act to amend the Museums Act in order to establish the Canadian Museum of History and to make consequential amendments to other Acts.
 

The Committee commenced its clause-by-clause study of the Bill.

 

The witnesses made statements and answered questions.

 

Pursuant to Standing Order 75(1), consideration of Clause 1, Short Title, was postponed.

The Chair called Clause 2.

 

On Clause 2,

Scott Simms moved, — That Bill C-49, in Clause 2, be amended by replacing line 10 on page 1 with the following:

“be called the Canadian Museum of History and Civilization.”

 

After debate, the question was put on the amendment of Scott Simms and it was negatived, by a show of hands: YEAS: 5; NAYS: 6.

 

The Chair ruled that the following sixteen (16) amendments were consequential to the previous amendment and therefore they were also adopted:

That Bill C-49, in Clause 2, be amended

(a) by replacing lines 10 and 11 on page 1 with the following:

“be called the Canadian Museum of History and Civilization.

(2) The Canadian Museum of History and Civilization shall”

(b) by replacing line 14 on page 1 with the following:

“Canadian Museum of History and Civilization may, by by-law,”

That Bill C-49, in Clause 2, be amended by replacing line 17 on page 1 to line 3 on page 2 with the following:

“8. The purpose of the Canadian Museum of History and Civilization is to enhance Canadians’ knowledge, critical understanding and appreciation of events, experiences, people and objects that reflect and have shaped Canada’s history and identity, and also to enhance their awareness of world history and cultures by various means, including by the expansion of, provision of access to and research of collections of objects of historical or cultural significance, with special but not exclusive reference to Canada.”

That Bill C-49, in Clause 2, be amended by replacing line 18 on page 1 with the following:

“History and Civilization is to enhance Canadians' knowledge,”

That Bill C-49, in Clause 2, be amended by replacing lines 4 to 9 on page 2 with the following:

“9. (1) In furtherance of its purpose, the Canadian Museum of History and Civilization has, subject to this Act, the capacity of a natural person and, elsewhere than in Quebec, the rights, powers and privileges of a natural person. In particular, the Canadian Museum of History and Civilization may”

That Bill C-49, in Clause 2, be amended by replacing line 15 on page 3 with the following:

“(2) The Canadian Museum of History and Civilization may”

That Bill C-49, in Clause 4, be amended by replacing lines 27 and 28 on page 3 with the following:

““new museum” means the Canadian Museum of History and Civilization established under section 7”

That Bill C-49, in Clause 11, be amended by replacing line 3 on page 5 with the following:

“Canada, the Canadian Museum of History and Civilization,”

That Bill C-49, in Clause 13, be amended by replacing lines 18 and 19 on page 5 with the following:

“Canadian Museum of History and Civilization

Musée canadien de l’histoire et des civilisations

That Bill C-49, in Clause 14, be amended by replacing line 24 on page 5 with the following:

“History and Civilization designated by the member of the”

That Bill C-49, in Clause 15, be amended by replacing line 32 on page 5 with the following:

“dian Museum of History and Civilization”.”

That Bill C-49, in Clause 17, be amended by replacing lines 3 and 4 on page 6 with the following:

“Canadian Museum of History and Civilization

Musée canadien de l’histoire et des civilisations

That Bill C-49, in Clause 18, be amended by replacing line 9 on page 6 with the following:

“Canada, the Canadian Museum of History and Civilization,”

That Bill C-49, in Clause 20, be amended by replacing lines 24 and 25 on page 6 with the following:

Musée canadien de l’histoire et des civilisations

That Bill C-49, in Clause 22, be amended by replacing lines 3 and 4 on page 7 with the following:

“Canadian Museum of History and Civilization

Musée canadien de l’histoire et des civilisations

That Bill C-49, in the Clause 1, be amended by replacing lines 4 and 5 on page 1 with the following:

“1. This Act may be cited as the Canadian Museum of History and Civilization Act.”

That Bill C-49 be amended by replacing the long title on page 1 with the following:

“An Act to amend the Museums Act in order to establish the Canadian Museum of History and Civilization and to make consequential amendments to other Acts”

 

Pursuant to the order adopted by the Committee on Monday, June 3, 2013, the following amendment, submitted by Jean-François Fortin for the consideration of the Committee, was deemed moved:

That Bill C-49, in Clause 2, be amended by replacing line 12 on page 1 with the following:

“not include the Canadian War Museum nor any”

After debate, the question was put on the amendment and it was negatived by a show of hands: YEAS: 4; NAYS: 7.

 

Pursuant to the order adopted by the Committee on Monday, June 3, 2013, the following amendment, submitted by Jean-François Fortin for the consideration of the Committee, was deemed moved:

“9.1 Three years after the day on which section 9 comes into force and at the end of each subsequent period of three years, a committee of the Senate, of the House of Commons or of both Houses of Parliament is to be designated or established for the purpose of reviewing the independent functioning of the Canadian Museum of History.”
