The Standing Committee on Justice and Human Rights met at 9:40 a.m. this day, in Room 371, West Block, the Chair, John Maloney, presiding.
Member(s) of the Committee present: Reg Alcock, Eleni Bakopanos, Chuck Cadman, Paul DeVillers, Ivan Grose, Peter MacKay, John Maloney, John McKay, John Reynolds and Jacques Saada.
Acting Member(s) present: Richard Harris for Jim Abbott, Pierre Brien for Michel Bellehumeur, Denis Coderre for Derek Lee.
In attendance: From the Library of Parliament: Marilyn Pilon, Researcher; Philip Rosen, Senior Analyst.
Witness(es): From the Canadian Bar Association: Heather E. Perkins-McVey, Vice-Chair, National Criminal Justice Section; Tamra L. Thomson, Director, Legislation and Law Reform.
Pursuant to Standing Order 68(4)(a) and the Order of Reference dated Thursday, October 30, 1997, the Standing Committee on Justice and Human Rights resumed consideration of the Criminal Code impaired driving provisions. (See Minutes of Proceedings dated Wednesday, February 3, 1999, Meeting No. 109)
Chuck Cadman moved, -- That the Standing Committee on Justice and Human Rights immediately examine the phenomenon of home invasion with a view to:
- expressing the seriousness with which Parliament views the act of invasion into homes and its terrorizing effect on the inhabitants, and,
- aggravating factor to be considered at sentencing upon conviction of any resulting offence, or,
- if deemed to be necessary, amending the Criminal code by creating a new offence.
Peter MacKay moved, -- That the motion be amended by deleting the word "immediately" and adding after the words "phenomenon of home invasion", the following: "in a timely fashion".
After debate, the amendment was unanimously agreed to.
After further debate, the question being put on the motion, as amended, it was negatived on the following division:
