Background

On December 12, Mr. Scott (Hamilton—Wentworth) introduced Bill C-622, the Hazardous Products Recall Act, which was read a first time; ordered to be printed; and ordered for second reading at the next sitting of the House. On December 15, the Speaker made a ruling regarding the bill's receivability at the time it was introduced.

Issue

Can a bill be introduced and read a first time before it has been drafted?

Decision

No. The proceedings relating the bill must be declared null and void.

Reasons given by the Speaker

The Standing Orders clearly stipulate that no bill may be introduced in either blank or an imperfect shape. Since the bill in question had not been drafted, it was therefore not ready for introduction. Until the bill is in written form, the notice will continue to be carried on the Order Paper under "Introduction of Bills".
