Motions without Notice Proposed under Standing Order 43 and Statements by Members under Standing Order 21 (Provisional) / Miscellaneous

Question previously voted on

Debates p. 3623

Background

Mr. Knowles (Winnipeg North Centre) requested the unanimous consent of the House to move a motion under the provisions of Standing Order 43. The motion expressed the House's reaffirmation of Bill C-40, an Act to amend the Statute Law (Military and Civilian War Pensions, Compensation and Allowances), passed earlier in the session, and called upon Mr. Lamontagne (Acting Minister of Veterans' Affairs) to introduce legislation to reduce the phasing-in period provided for in the legislation. The Speaker ruled immediately.

Issue

Can a Member propose a motion on a matter that has already been voted on by the House?

Decision

No. The motion is out of order.

Reasons given by the Speaker

Because the House has already voted on this piece of legislation, the Member may not propose a motion reaffirming approval of the legislation but disagreeing with one of its provisions.
