Background
At report stage of Bill C-23 (Act to amend the Small Businesses Loans Act), a motion standing on the Notice Paper in the name of Mr. Gagliano (Saint-Leonard—Anjou) sought to return to the provisions of the original Act whereby the Minister is liable to pay to a bank the amount of any loss sustained by it as a result of a business improvement loan made after January 18, 1961. The Speaker expressed reservations about the procedural acceptability of the motion.
Issue
Is a motion in amendment in order if it reinstates a provision of the original Act which is not covered by the Royal Recommendation attached to the bill?
Decision
No. The motion is out of order.
Reasons given by the Speaker
The reinstatement of the provision would eliminate the March 31,1985, time limit on the Minister's liability for losses on loans, and would therefore relax a condition of the Royal Recommendation.
