Whereas:
  • Canada is a diasporic home to largest number of Eelam Tamils, a nation of people facing protracted genocide for over 75 years in their occupied traditional homeland, Tamil Eelam, in the island of Sri Lanka (SL);
  • The SL State has grossly violated EelamTamils' Right of Self-Determination;
  • The State-sponsored physical genocide has manifested in various ways, from anti-Tamil ethnic pogroms in 1956, massacres and finally a genocidal war that ended in total annihilation of de-facto Tamil Eelam in May 2009;
  • The protracted nature of Tamil genocide is a unique feature and all ten stages of genocide have occurred since the beginning of invocable temporal jurisdiction of the 1948 Genocide Convention and the risk of recurrence remains high;
  • The SL State has disputed both The House of Commons motion passed on 19th June 2019 that called on the UN to investigate into allegations of genocide and the Legislative Assembly of Ontario enacted Bill 104.
We, the undersigned, Citizens and residents of Canada, call upon the House of Commons to 1. Invoke Canada’s responsibilities on two grounds – as an injured State party on behalf of its citizens of Eelam Tamil heritage and as a State party exercising erga omnes partes obligation – to initiate proceedings against the Republic of Sri Lanka at the International Court of Justice to investigate that State’s responsibility on Tamil genocide under the Convention’s Article IX covering entire temporal jurisdiction; and
2. Call for an internationally administered referendum among the people in the occupied homeland and the diaspora, to decide on the creation of an independent and sovereign state of Tamil Eelam.
