Petition to the House of Commons

We, the undersigned, residents of the City of Ottawa, in the province of Ontario, as well as the surrounding areas such as the city of Gatineau-Hull, in the province of Québec, and areas affected by the lands of National Capital Commission in the, or our, country of Canada draw the attention of the House to the following:

Whereas:

The National Capital Commission (NCC) is unable to effectively patrol, ticket and tow vehicles that illegally park on its lands, such as at the Vincent Massey Park's (VMP) parking lot between their signed offence "no parking" hours of 10 pm to 7 am;

This area is prone to chronic noise pollution often in violation of local City of Ottawa Noise Bylaws due to the use of sound amplification systems. These noises negatively affect neighbouring properties, users of the VMP park and/or the NCC lands, and local wildlife;

There is currently no federal regulation or law that allows for NCC conservation officers the powers to enforce or dissuade the use of sound amplification systems within the park;

Violators who often park past the NCC's 10 pm no parking signed "curfew", often violate the sanctity of our neighbourhood by blasting loud music;

Illegally parked vehicles often obstruct the firelane at VMP;

Partiers often drink alcohol in violation of the NCCs regulations; and

The NCC does not have the "manpower" or capability to always enforce and only plans to employ 4 parking infraction officers for the upcoming 2024 season.

THEREFORE:

Your petitioners request that Parliament create a memorandum of understanding (MOU) and/or agreements between the National Capital Commission (NCC) and the City of Ottawa so that the City of Ottawa Bylaw and Police may enforce the signed offences of "No Parking" regulations at VMP or other NCC lands within the area of Ottawa, Ontario;

Your petitioners request Parliament, in collaboration with the federal Government, update the current NCC land regulations to further protect users of the NCC lands from chronic noise pollution created by sound amplification systems and/or gas generators. WHEREAS such devices and actions should be prohibited, and only allowed under certain circumstances per proper land management or permits granted by the NCC;

Your petitioners request that any regulation be in line with the City of Ottawa Noise Bylaws and allow for enforcement with an MOU between the City of Ottawa Bylaw or Police at Vincent Massey Park (VMP);

Please ensure the "assermentation" of a good number of NCC Conservation Officers, NCC parking infraction officers and Ottawa Bylaw officers with the RCMP, who may patrol the NCC's VMP under an MOU.

The role of the National Capital Commission (NCC), as defined by the National Capital Act, is “to prepare plans for and assist in the development, conservation and improvement of the National Capital Region in order that the nature and character of the seat of the Government of Canada may be in accordance with its national significance.” As a Crown corporation, the NCC fulfills this role by setting the long-term planning direction for federal lands in the National Capital Region (NCR), as well as managing, conserving, and protecting built and natural assets that are significant to Canada’s symbolic, natural, and cultural heritage.

As the largest landowner in the NCR, the NCC cares for over 47,000 hectares of federal public lands in Ontario and Quebec. The corporation’s stewardship responsibilities are central to its mandate delivery, alongside a commitment to ensuring that Canadians can enjoy safe, appropriate, and sustainable access to these public spaces, year-round.

Vincent Massey Park is a beloved urban park along the Rideau River in Ottawa, Ontario. Covering 28.9 hectares, this popular green space has been an ideal site for hosting community gatherings, company picnics, and family reunions for over 60 years. The NCC’s multi-use pathway network also passes through the park, making it a great starting point to exploring the Capital.

While providing residents and visitors with opportunities to access and enjoy green spaces like Vincent Massey Park, the NCC must also protect and preserve order on its public property. The NCC Traffic and Property Regulations provide the NCC’s team of Conservation Officers with the authority to safeguard treasured destinations in the Capital for all users, as well as to protect biodiversity. Every day they patrol nearly 1,100 km2 of NCC land, including urban parks, to ensure compliance.

Given the unique multi-jurisdictional nature of land management in the NCR, the NCC’s Conservation Officers also partner with regional police forces, municipalities, and the Royal Canadian Mounted Police to ensure the safety and enjoyment of public spaces. This collaboration is essential to supporting the enforcement of regulations by the appropriate governing authority, as well as to advancing a cohesive and coordinated emergency response.

The Government of Canada recognizes the importance of safe, equitable, and sustainable access to federal public lands within the NCR. The Government will continue to support the NCC’s stewardship mandate so that these nationally significant public places remain a legacy for future generations.
