| Pursuant to Standing Order 108(2) and a motion adopted by the Committee on Thursday, May 19, 2005, your Committee, in response to the recent remarks by the Chief Justice of the Appeal Court of Québec, Michel Robert, that it is acceptable to discriminate on the basis of political opinion when appointing candidates to the federal judiciary, draws to the attention of the House that it strongly condemns Michel Robert’s remarks who has failed to abide by the principle of judicial restraint and has threatened the principle of judicial independence. | Conformément à l'article 108(2) du Règlement et la motion adoptée par le Comité le jeudi 19 mai 2005, votre Comité, à la suite des récents propos du juge en chef de la Cour d'appel du Québec, Michel Robert, selon lesquels une discrimination basée sur l'opinion politique est acceptable dans la nomination des candidats à la magistrature fédérale, informe la Chambre qu'il condamne fermement les propos de Michel Robert qui a failli à son devoir de réserve et entaché le principe de l’indépendance du pouvoir judiciaire. |
| Your Committee also want to inform the House that it agreed to undertake, pursuant to the study of the process for appointments to the Supreme Court already carried out, a study of the process for all appointing judges within the federal judgeship nomination in order to propose a more transparent process in which there is no form of discrimination – including for reasons of political orientation. | Votre Comité désire aussi informer la Chambre qu'il a a convenu d'entreprendre, suite à l'étude du processus de nomination à la Cour suprême déjà réalisée, une étude du processus de toutes les nominations à la magistrature de nomination fédérale afin de proposer un processus plus transparent dans lequel aucune forme de discrimination - y compris pour des raisons d'orientation politique - ne sera présente. |
