Pursuant to Order made Thursday, May 12, 2016, the House proceeded to the taking of the deferred recorded division on the motion of Mr. Fast (Abbotsford), seconded by Mr. MacKenzie (Oxford), — That, in the opinion of the House, given the importance of trade to Canadian jobs and long-term growth, as well as the government’s commitment to strengthen ties within North America and the Asia-Pacific region: (a) growing protectionism threatens the global economy; (b) the Trans-Pacific Partnership is the best opportunity to strengthen the multilateral trading system and develop rules that protect Canada’s economic interests; (c) the government should send a strong signal to Canadian businesses and its closest allies that it supports international commerce; (d) Canada’s position on the Trans-Pacific Partnership should not depend on political developments in the United States; (e) the government should stop prolonging consultations on this important agreement; and (f) the government should declare Canada’s final position on the Trans-Pacific Partnership in time for the North American Leaders’ Summit in Ottawa on June 29, 2016.

Pursuant to Order made Thursday, May 12, 2016, the House proceeded to the taking of the deferred recorded division on the motion of Mr. Viersen (Peace River—Westlock), seconded by Mrs. Wagantall (Yorkton—Melville), — That, in the opinion of the House: (a) it is in the public interest to protect the freedom of conscience of a medical practitioner, nurse practitioner, pharmacist or any other health care professional who objects to take part, directly or indirectly, in the provision of medical assistance in dying; (b) everyone has freedom of conscience and religion under section 2 of the Canadian Charter of Rights and Freedoms; (c) a regime that would require a medical practitioner, nurse practitioner, pharmacist or any other health care professional to make use of effective referral of patients could infringe on the freedom of conscience of those medical practitioners, nurse practitioners, pharmacists or any other health care professional; and (d) the government should support legislation to protect the freedom of conscience of a medical practitioner, nurse practitioner, pharmacist or any other health care professional.

Motions

By unanimous consent, it was ordered, — That, notwithstanding any Standing Order or usual practice of the House, Bill C-11, An Act to amend the Copyright Act (access to copyrighted works or other subject-matter for persons with perceptual disabilities), be deemed read a second time and referred to a Committee of the Whole, deemed considered in Committee of the Whole, deemed reported without amendment, deemed concurred in at the report stage and deemed read a third time and passed.

Government Orders

The Order was read for the consideration at report stage of Bill C-14, An Act to amend the Criminal Code and to make related amendments to other Acts (medical assistance in dying), as reported by the Standing Committee on Justice and Human Rights with amendments.

Pursuant to Standing Order 76.1(5), the Speaker selected and grouped for debate the following motions:

Group No. 1 — Motions Nos. 1, 3, 4, 6, 7, 9, 12 to 14, and 16.

Group No. 1

Mr. Rankin (Victoria), seconded by Ms. Sansoucy (Saint-Hyacinthe—Bagot), moved Motion No. 1, — That Bill C-14 be amended by deleting Clause 3.

Mr. Genuis (Sherwood Park—Fort Saskatchewan), seconded by Mr. Cooper (St. Albert—Edmonton), moved Motion No. 3, — That Bill C-14, in Clause 3, be amended by adding after line 5 on page 6 the following:

“(f) prior to making the request, they consulted a medical practitioner regarding palliative care options and were informed of the full range of options.”

Mr. Cooper (St. Albert—Edmonton), seconded by Mr. Genuis (Sherwood Park—Fort Saskatchewan), moved Motion No. 4, — That Bill C-14, in Clause 3, be amended by adding after line 5 on page 6 the following:

“(f) they have, if they suffer from an underlying mental health condition, undergone a psychiatric examination performed by a certified psychiatrist to confirm their capacity to give informed consent to receive medical assistance in dying.”

Mr. Thériault (Montcalm), seconded by Mr. Ste-Marie (Joliette), moved Motion No. 6, — That Bill C-14, in Clause 3, be amended by deleting lines 17 to 21 on page 6.

Mr. Genuis (Sherwood Park—Fort Saskatchewan), seconded by Mr. Cooper (St. Albert—Edmonton), moved Motion No. 7, — That Bill C-14, in Clause 3, be amended by replacing lines 17 to 21 on page 6 with the following:

“(d) their imminent natural death has become foreseeable, taking into account all of their medical circumstances.”

Mr. Cooper (St. Albert—Edmonton), seconded by Mr. Genuis (Sherwood Park—Fort Saskatchewan), moved Motion No. 9, — That Bill C-14, in Clause 3, be amended by adding after line 26 on page 6 the following:

“(a.1) with regard to paragraph (1)(f), have obtained from the certified psychiatrist a written and signed report following the examination confirming that the person is capable of giving informed consent;”

Mr. Genuis (Sherwood Park—Fort Saskatchewan), seconded by Mr. Cooper (St. Albert—Edmonton), moved Motion No. 12, — That Bill C-14, in Clause 3, be amended by adding after line 30 on page 7 the following:

“(3.1) As it relates to medical assistance in dying, no medical practitioner or nurse practitioner may administer a substance to a person if they and the medical practitioner or nurse practitioner referred to in paragraph (3)(e) concur that the person is capable of self-administering the substance.”

Mr. Genuis (Sherwood Park—Fort Saskatchewan), seconded by Mr. Cooper (St. Albert—Edmonton), moved Motion No. 13, — That Bill C-14, in Clause 3, be amended by adding after line 30 on page 7 the following:

“(3.1) The medical practitioner or nurse practitioner shall not provide a person with assistance in dying if the criteria in subsection (1) and the safeguards in subsection (3) have not been reviewed and verified in advance

(a) by a competent legal authority designated by the province for that purpose; or

(b) if no designation is made under paragraph (a), by a legal authority designated by the Minister of Health in conjunction with the Minister of Justice for that purpose.

(3.2) The designation referred to in paragraph (3.1)(b) ceases to have effect if the province notifies the Minister of Justice that a designation has been made under paragraph (3.1)(a).”

Mr. Cooper (St. Albert—Edmonton), seconded by Mr. Genuis (Sherwood Park—Fort Saskatchewan), moved Motion No. 14, — That Bill C-14, in Clause 3, be amended by adding after line 26 on page 8 the following:

“(7.1) It is recognized that the medical practitioner, nurse practitioner, pharmacist or other health care institution care provider, or any such institution, is free to refuse to provide direct or indirect medical assistance in dying.

(7.2) No medical practitioner, nurse practitioner, pharmacist or other healthcare institution care provider, or any such institution, shall be deprived of any benefit, or be subject to any obligation or sanction, under any law of the Parliament of Canada solely by reason of their exercise, in respect of medical assistance in dying, of the freedom of conscience and religion guaranteed under the Canadian Charter of Rights and Freedoms or the expression of their beliefs in respect of medical assistance in dying based on that guaranteed freedom.”

Ms. May (Saanich—Gulf Islands), seconded by Mr. Thériault (Montcalm), moved Motion No. 16, — That Bill C-14, in Clause 9.1, be amended by replacing line 22 on page 13 with the following:

“Health, no later than 45 days after the day”

Notices of Motions

Mr. LeBlanc (Leader of the Government in the House of Commons) gave notice of the intention to move a motion at the next sitting of the House, pursuant to Standing Order 78(3), for the purpose of allotting a specified number of days or hours for the consideration and disposal of the report stage and third reading stage of Bill C-14, An Act to amend the Criminal Code and to make related amendments to other Acts (medical assistance in dying).

Private Members' Business

At 5:49 p.m., pursuant to Standing Order 30(7), the House proceeded to the consideration of Private Members' Business.

The Order was read for the second reading and reference to the Standing Committee on Human Resources, Skills and Social Development and the Status of Persons with Disabilities of Bill C-243, An Act respecting the development of a national maternity assistance program strategy and amending the Employment Insurance Act (maternity benefits).

Mr. Gerretsen (Kingston and the Islands), seconded by Mrs. Romanado (Longueuil—Charles-LeMoyne), moved, — That the Bill be now read a second time and referred to the Standing Committee on Human Resources, Skills and Social Development and the Status of Persons with Disabilities.

Debate arose thereon.

Pursuant to Standing Order 93(1), the Order was dropped to the bottom of the order of precedence on the Order Paper.
