The Standing Committee on Transport, Infrastructure and Communities met at 11:04 a.m. this day, in Room 362, East Block, the Chair, Merv Tweed, presiding.

 

Members of the Committee present: Dennis Bevington, Hon. Gerry Byrne, Cheryl Gallant, Roger Gaudet, Michel Guimond, Brian Jean, Colin Mayes, Hon. John McCallum, Brad Trost, Merv Tweed and Jeff Watson.

 

Acting Members present: Kevin Lamoureux for Sukh Dhaliwal.

 

Other Members present: Jim Maloway and Hon. Anita Neville.

 

In attendance: Library of Parliament: John Christopher, Analyst.

 

Witnesses: International Association of Machinists and Aerospace Workers - Local lodge 1751: Serge Gélinas, Secretary-Treasurer ; Richard Guay, Recording Secretary; Jean Poirier, Vice-President; Marcel St-Jean, President.

 
Pursuant to Standing Order 108(2), the Committee resumed its study of issues related to the Air Canada Public Participation Act (ACPPA).
 

Jean Poirier and Serge Gélinas made statements and, with the other witnesses, answered questions.

 

At 12:16 p.m., the sitting was suspended.

At 12:21 p.m., the sitting resumed.

 
The Committee proceeded to the consideration of matters related to Committee business.
 

The Committee resumed consideration of the motion of John McCallum, — That the Committee hold a meeting on Thursday, March 24, 2011, from 11:00 a.m. to 1:00 p.m., to study the current situation with regard to airport limousine drivers at Pearson International Airport; that representatives of the drivers, the limousine companies and the Greater Toronto Airports Authority (GTAA) be asked to appear; that the Committee report its findings to the House; and that no motions, dilatory or otherwise, be entertained by the Chair at said meeting.

 

RULING BY THE CHAIR

The Chair ruled the proposed motion inadmissible as he felt the sub-judice convention applies to this motion as described on pages 99 and 100 of House of Commons Procedure and Practice, Second Edition.

 

Whereupon, John McCallum appealed the decision of the Chair.

The question: "Shall the decision of the Chair be sustained?" was put and the decision was overturned on the following recorded division: YEAS: Cheryl Gallant, Brian Jean, Colin Mayes, Brad Trost, Jeff Watson — 5; NAYS: Dennis Bevington, Gerry Byrne, Roger Gaudet, Michel Guimond, Kevin Lamoureux, John McCallum — 6.

 

At 12:27 p.m., the Hon. John McCallum took the Chair.

 

At 12:51 p.m., Michel Guimond took the Chair.

 

The debate continued.

 

Dennis Bevington moved, — That the motion be amended by replacing the words “on Thursday, March 24, 2011, from 11:00 a.m. to 1:00 p.m., with the words “at the earliest available opportunity after the final decision of the Labour Relation Board on this matter”.

 

After debate, the question was put on the amendment of Dennis Bevington and it was agreed to, by a show of hands: YEAS: 5; NAYS: 0.

 

The question was put on the motion, as amended, and it was agreed to on the following recorded division: YEAS: Dennis Bevington, Gerry Byrne, Roger Gaudet, Kevin Lamoureux, John McCallum — 5; NAYS: Brian Jean, Colin Mayes, Brad Trost, Jeff Watson — 4.

 

The motion, as amended, read as follows:

That the Committee hold a meeting at the earliest available opportunity after the final decision of the Labour Relation Board on this matter to study the current situation with regard to airport limousine drivers at Pearson International Airport; that representatives of the drivers, the limousine companies and the Greater Toronto Airports Authority (GTAA) be asked to appear; that the Committee report its findings to the House; and that no motions, dilatory or otherwise, be entertained by the Chair at said meeting.

 

On motion of Brian Jean, it was agreed, — That the Committee do now adjourn.

 

At 12:57 p.m., the Committee adjourned to the call of the Chair.
