The Standing Committee on Human Resources, Skills and Social Development and the Status of Persons with Disabilities met at 3:35 p.m. this day, in Room 308, West Block, the Chair, Dean Allison, presiding.

Members of the Committee present: Dean Allison, Josée Beaudin, Ron Cannan, Raymonde Folco, Ed Komarnicki, Yves Lessard, Ben Lobb, Tony Martin, Hon. Maria Minna, Michael John Savage and Maurice Vellacott.

Acting Members present: Brian Jean for Dona Cadman, Gerard Kennedy for Hon. Maria Minna and Megan Anissa Leslie for Tony Martin.

Associate Members present: Libby Davies.

In attendance: Library of Parliament: Hilary Jensen, Analyst ; André Léonard, Analyst . House of Commons: Wayne Cole, Legislative Clerk ; Lucie Tardif-Carpentier, Legislative Clerk.

Pursuant to the Order of Reference of Wednesday, September 30, 2009, the Committee resumed consideration of Bill C-304, An Act to ensure secure, adequate, accessible and affordable housing for Canadians.

The Committee resumed its clause-by-clause study of the Bill.

On Clause 5,

The Committee resumed consideration of the amendment of Gerard Kennedy, — That Bill C-304, in Clause 5, be amended by adding after line 8 on page 5 the following:

“(d) develop a process by which an independent body will review, address and report on complaints about possible violations of any housing rights recognized by this Act.”

By unanimous consent, the amendment was withdrawn.

Gerard Kennedy moved, — That Bill C-304, in Clause 5, be amended by adding after line 8 on page 5 the following:

“(d) develop a process for the independent review, addressing and reporting of complaints about possible violations of the right to adequate housing.”

After debate, the question was put on the amendment of Gerard Kennedy and it was agreed to.

Gerard Kennedy moved, — That Bill C-304, in Clause 5, be amended by adding after line 8 on page 5 the following:

“(d) develop a process for review and follow-up on any concerns or recommendations received from United Nations human rights bodies with respect to the right to adequate housing in Canada.”

After debate, the question was put on the amendment of Gerard Kennedy and it was agreed to.

Clause 5, as amended, carried on division.

On Clause 6,

Gerard Kennedy moved, — That Bill C-304, in Clause 6, be amended by replacing line 11 on page 5 with the following:

“paragraphs 5(a) to (e), to be laid before each”

After debate, the question was put on the amendment of Gerard Kennedy and it was agreed to on division.

Clause 6, as amended, carried on division.

By unanimous consent, the Committee reverted to Clause 2 previously stood.

On Clause 2,

Megan Anissa Leslie moved, — That Bill C-304, in Clause 2, be amended by adding after line 12 on page 2 the following:

““Aboriginal community” means a community made up of Métis, Inuit or First Nations peoples, whether or not that community is situated on a reserve.”

After debate, the question was put on the amendment of Megan Anissa Leslie and it was agreed to on division.

Megan Anissa Leslie moved, — That Bill C-304, in Clause 2, be amended by replacing line 16 on page 2 with the following:

“challenged by age, physical or mental”

The Chair ruled the proposed amendment inadmissible because it proposed a substantive amendment to the Bill by way of a modification to the interpretation clause, as provided on page 769 of House of Commons Procedure and Practice, Second Edition.

Gerard Kennedy moved, — That Bill C-304, in Clause 2, be amended by replacing lines 27 and 28 on page 2 with the following:

“including food, clothing and access to health care services, education and recreational activities.”

After debate, the question was put on the amendment of Gerard Kennedy and it was agreed to on division.

Clause 2, as amended, carried on division.

The Preamble carried on division.

The Short Title carried on division.

The Title carried on division.

The Bill, as amended, carried on division.

ORDERED, — That the Chair report the Bill, as amended, to the House.

ORDERED, — That Bill C-304, as amended, be reprinted for the use of the House at report stage.

At 4:07 p.m., the sitting resumed.

Pursuant to the Order of Reference of Thursday, November 5, 2009, and the motion adopted by the Committee on Thursday, November 26, 2009, the Committee resumed consideration of the subject-matter of Bill C-56, An Act to amend the Employment Insurance Act and to make consequential amendments to other Acts.

Michel Bédard made a statement and answered questions.

At 5:13 p.m., the Committee adjourned to the call of the Chair.
