The Standing Committee on Canadian Heritage met in camera at 9:17 a.m. this day, in Room 362 East Block, the chair, Sarmite Bulte, presiding.

 

Members of the Committee present: Jim Abbott, Paul Bonwick, Sarmite Bulte, Jeannot Castonguay, John Harvard, Nancy Karetak-Lindell, Clifford Lincoln and Gary Schellenberger.

 

Acting Members present: Benoît Sauvageau for Christiane Gagnon and Bob Wood for Mark Assad.

 

In attendance: Library of Parliament: Sam Banks, Analyst.

 

Witnesses: Canadian Private Copying Collective: Claude Brunet, Legal Counsel, Ogilvy Renault. Balanced Copyright Coalition: Howard P. Knopf, Member. The Committee proceeded to the consideration of matters related to Committee business.
 

It was agreed, — That the Standing Committee on Canadian Heritage recommend the following timelines and commitments to the Department’s of Industry and Heritage with respect to the balance of the work to be done as outlined in their Status Report on Copyright Reform as presented to the Committee on March 25, 2004. In the event that this Committee’s work is interrupted, this moves that these commitments be part of the Committee's record.

 

Timelines & Commitments

  • That the departments respect the longstanding commitment of the Government to ratify the WIPO Treaties signed in December 1997.
  • That legislation to permit ratification be introduced in the House of Commons by February 2005.
  • That a memorandum to cabinet be ready to be approved by Cabinet no later than November 15, 2004.
  • That items other than the WCT & WPPT as identified in the Short Term Issues in the Section 92 report be addressed on the same timeline.
 

It was agreed, — That the Standing Committee on Canadian Heritage instruct its research staff to prepare a narrative historic record, distinct from the minutes and evidence of the Committee that will record the developments from the beginning of this Committee’s review of the Copyright Act to a point, whenever it occurs, that this committee may be dissolved. This narrative to be adopted by the Committee, should attempt, as accurately as possible, to capture the frustration and disappointment of the Committee and the witnesses, including former Ministers as they have struggled to find answers to the delays that have plagued this file.

 

It was agreed, — That the Committee retain the professional services of Elizabeth F. Judge, as a consultant to assist in organizing the work of the Committee in relation to its study of the Government Status Report on the Copyright Reform for the period of April 21 to June 23, 2004 at a per diem rate of $ 600.00 for a total amount not to exceed $ 27,000.00.

 

It was agreed, — That, in relation to its study of the Government Status Report on the Copyright Reform, the Committee approve the proposed operational budget in the amount of $42,350.00 for the period of April 20 to June 23, 2004 and that the Chair present the said budget request to Liaison Committee.

 

At 9:46 a.m., the sitting was suspended.

 

At 9:50 a.m., the Committee resumed in public.

 
Pursuant to Standing Order 108(2), the Committee resumed its study of the Government Status Report on Copyright Reform - Private Copying and WIPO Ratification.
 

The witnesses made statements and answered questions.

 

At 12:03 p.m., the Committee adjourned to the call of the Chair.
