In accordance with its mandate under Standing Order 111.1(1) and the Order of reference of October 29, 2003, your committee examined all matters relating to the Proposed Appointment of Jennifer Stoddart as Privacy Commissioner of Canada and has agreed to report the following:	Conformément au mandat que lui confère l’article 111.1(1) du Règlement  et l’ordre de renvoi du 29 octobre 2003, votre comité a examiné toutes les questions relatives à la nomination proposée de Mme Jennifer Stoddart au poste de Commissaire à la protection de la vie privée du Canada et a convenu de présenter le rapport suivant :
This report provides the House with a statement of the findings and recommendation of the Standing Committee on Government Operations and Estimates relating to the proposed appointment of Ms. Jennifer Stoddart as Privacy Commissioner of Canada.	Le présent rapport fournit à la Chambre un exposé des conclusions et de la recommandation du Comité permanent des opérations gouvernementales et des prévisions budgétaires relativement à la nomination proposée de Mme Jennifer Stoddart au poste de Commissaire à la protection de la vie privée du Canada.
BACKGROUND	CONTEXTE
Following the resignation of the previous Privacy Commissioner in June of this year, the Committee tabled a report listing a series of “next steps” to be taken after the return of Parliament. Regarding the appointment of a permanent successor to Mr. Radwanski: we intend to scrutinize any prospective candidate prior to any vote by Parliament on the matter. By declaring its intentions in this manner, the Committee sent a signal to the Government of its desire to make full and appropriate use of the authority conferred by the Standing Orders, which read as follows:	En déclarant ses intentions de la sorte, le Comité a signalé au gouvernement son désir d’utiliser pleinement et de manière appropriée les pouvoirs que lui confère le Règlement, à savoir :
111.1 (1) Where the Government intends to appoint an Officer of Parliament, the Clerk of the House or the Parliamentary Librarian, the name of the proposed appointee shall be deemed referred to the appropriate standing committee which may consider the appointment during a period of not more than thirty days following the tabling of a document concerning the proposed appointment.	111.1 (1) Lorsque le gouvernement a l’intention de nommer un haut fonctionnaire de la Chambre, le Greffier de la Chambre ou le Bibliothécaire du Parlement, le nom du candidat est réputé avoir été renvoyé au comité permanent compétent qui peut examiner la nomination pendant au plus trente jours après le dépôt d’un document concernant la nomination du candidat.
On October 29, 2003, pursuant to Standing Order 111.1(1), the examination of the proposed appointment of Ms. Jennifer Stoddart to the position of Privacy Commissioner was referred to the Committee by the House of Commons.	Le 29 octobre 2003, conformément à l’alinéa 111.1(1) du Règlement, l’examen de la nomination proposée de Mme Jennifer Stoddart au poste de Commissaire à la protection de la vie privée a été renvoyé au Comité par la Chambre des communes.
The Committee has responded to this Order of Reference on an urgent basis. The term of Mr. Robert Marleau, the Interim Privacy Commissioner, lapses on December 31, 2003. The need for the disposition of this matter before the end of the year, combined with the possibility that Parliament may rise in the very near future, has required the Committee to carry out its work in a matter of days, rather than utilizing the month-long period provided for in the Standing Orders.	Le Comité a répondu de manière urgente à cet ordre de renvoi. Le mandat de M. Robert Marleau, Commissaire intérimaire à la protection de la vie privée, se termine le 31 décembre 2003. La nécessité de régler cette question avant la fin de l’année, combinée à la possibilité que le Parlement puisse bientôt ajourner, a obligé le Comité à s’acquitter de cette tâche en quelques jours à peine, plutôt que d’utiliser la période d’un mois prévue au Règlement.
In the time available to it, the Committee has held two hearings, on the morning and afternoon of Novermber 4, 2003. In the morning, it received testimony from Mr. Robert Marleau, who as Interim Privacy Commissioner has made an enormous contribution to the OPC in a very limited time, and who participated directly in the selection of a candidate. Testimony was also received by video‑conference from Dr. David Flaherty, who combines extensive experience as both a scholar and a practitioner in the area of privacy rights. In the afternoon, the Committee examined the selected candidate, Ms. Jennifer Stoddart (presently the President of the Commission d’accès à l’information du Québec).	Dans le temps dont il a disposé, le Comité a tenu deux audiences, en matinée et en après-midi, le 4 novembre dernier. Le matin, il a entendu M. Robert Marleau, qui à titre de Commissaire intérimaire à la protection de la vie privée a apporté une énorme contribution au Commissariat à la protection de la vie privée (CPVP) en fort peu de temps, et a directement participé à la sélection d’un candidat. Le Comité a également entendu par vidéoconférence M. David Flaherty, qui cumule une vaste expérience en tant qu’universitaire et intervenant dans le domaine des droits à la protection de la vie privée. En après-midi, le Comité a reçu la candidate retenue, Mme Jennifer Stoddart (actuellement présidente de la Commission d’accès à l’information du Québec).
The remainder of this Report presents the findings and recommendations emerging from these meetings and the deliberations of the Committee.	Le reste de ce rapport présente les conclusions et la recommandation découlant de ces rencontres et des délibérations du Comité.
FINDINGS AND RECOMMENDATION	CONCLUSIONS ET RECOMMANDATION
The Committee has considered the central requirements of the position of Privacy Commissioner. We wish to draw attention, in particular, to the need for a broad understanding of privacy rights and their role in contemporary society; strong management and administrative skills; and the judgement, leadership and communications capacities required by a position that relies centrally on advice and persuasion rather than the unilateral imposition of solutions.	Le Comité a examiné les exigences fondamentales du poste de Commissaire à la protection de la vie privée. Nous tenons à attirer l’attention, en particulier, sur l’importance, pour le titulaire, de bien comprendre en quoi consistent les droits à la protection de la vie privée et leur rôle dans la société contemporaine; de posséder de solides compétences en gestion et en administration, et de faire montre du jugement, du leadership et des capacités de communication nécessaires pour occuper un poste dans lequel il doit essentiellement fournir des conseils et faire preuve de persuasion plutôt que d’imposer unilatéralement des solutions.
With these requirements in mind, we have reviewed the selection criteria employed by the search committee that recommended Ms. Stoddart. In our opinion, they provide a satisfactory framework for the identification and assessment of possible candidates.	En tenant compte de ces exigences, nous avons examiné les critères de sélection utilisés par le comité de recherche qui a recommandé Mme Stoddart. À notre avis, elles fournissent un cadre satisfaisant pour identifier et évaluer les candidats éventuels.
Also with these requirements in mind, we have extensively examined Ms. Stoddart’s qualifications, views concerning privacy rights, track record as an administrator and manager, and overall personal suitability. We have taken into account the advice of our expert witnesses, and her extensive accomplishments in law and legal scholarship, human rights administration and advocacy, and most recently as President of the Commission de l’accès à l’information du Québec. As well, we have explored, with Ms. Stoddart, her future-oriented vision of the place of privacy rights in a modern society, and have formed a very positive judgement both of the substance of her views and of her capacity to communicate them in a way that will contribute to positive change.	Toujours en tenant compte de ces exigences, nous avons examiné les qualifications de Mme Stoddart, ses opinions concernant les droits à la protection de la vie privée, sa feuille de route en tant qu’administratrice et gestionnaire, et ses qualités personnelles en profondeur. Nous avons pris en considération les témoignages de nos témoins experts, ainsi que les importantes réalisations de Mme Stoddart dans les domaines du droit et de la recherche en droit, de l’administration et de la défense des droits de la personne, et plus récemment, de son travail en tant que présidente de la Commission de l’accès à l’information du Québec. En outre, nous avons exploré, avec Mme Stoddart, sa vision de la place que devraient occuper les droits à la protection de la vie privée dans une société moderne, et avons pu ainsi nous faire une idée très positive de la substance de ses opinions et de sa capacité à les communiquer d’une façon qui contribuera à amener des changements positifs.
Accordingly, we find that Ms. Stoddart is an excellent candidate for the position of Privacy Commissioner of Canada. We believe that she will be effective in tackling the central challenges that face the new Privacy Commissioner. Among these are continuing the process of rebuilding that has been successfully begun by the Interim Privacy Commissioner, and building the bridges to governments and citizens that will be critically important as the Personal Information Protection and Electronic Documents Act broadens the responsibilities of the OPC beyond the federally-regulated private sector, starting in the new year.	Par conséquent, nous sommes d’avis que Mme Stoddart constitue une excellente candidate au poste de Commissaire à la protection de la vie privée du Canada. Nous croyons qu’elle saura efficacement relever les importants défis auxquels le nouveau Commissaire sera confronté. Elle devra notamment poursuivre le processus de reconstruction amorcée avec succès par le Commissaire intérimaire; tisser avec les gouvernements et les citoyens des liens qui seront d’une importance capitale puisque que la Loi sur la protection des renseignements personnels et les documents électroniques élargira les responsabilités du CPVP au-delà du secteur privé assujetti à la compétence fédérale, à compter du début de l’an prochain.
We therefore recommend:	Par conséquent, nous recommandons :
That the Government proceed, as provided in Standing Order 111.1(2), with the appointment of Ms. Jennifer Stoddart as Privacy Commissioner of Canada, and that the House ratify the appointment.	Que le gouvernement procède, en vertu de l’alinéa 111.1(2) du Règlement, à la nomination de Mme Jennifer Stoddart au poste de Commissaire à la protection de la vie privée du Canada, et que la Chambre ratifie la nomination.
